ORDINANCE: O-2004-31
SUBJECT: Ordinance to vacate certain portions of rights-of-way for West Byers Avenue, West Byers Place and South Vance Street, which were erroneously described by Ordinance O-78-102, further declaring an emergency.
ADDRESS: South Vance Street between West Alameda Avenue and West Byers Avenue.
RECOMMENDATION: Approve Ordinance O-78-102.
FUNDING SOURCE: Not applicable.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Ordinance O-78-102 vacated portions of cul-de-sac bulbs along the east side of the Bennigan's restaurant property on the northwest corner of West Alameda Avenue and South Vance Street. This also included portions of right-of-way on the east side of South Vance Street. A pending sale of the apartment complex on the east side has revealed that there were errors in the legal descriptions. These errors leave a cloud in the title of the apartment property, which can only be cleared up by a new vacation ordinance. The property transaction cannot close until the ordinance is effective, thus creating the need for an emergency ordinance.
