ORDINANCE: O-2004-30
SUBJECT: Amending sections of the Lakewood Municipal Code Related to Park and Open Space Dedications.

RECOMMENDATION: The Departments of Finance and Community Resources recommend the adoption of this ordinance amending the parts of the Park and Open Space Dedication requirements of the City.
FUNDING SOURCE: Conservation Trust Fund
SUMMARY AND BACKGROUND OF SUBJECT MATTER: In 1974 the City set up the City's
Conservation Trust Fund to receive monies provided by the State for specific
Park and Open Space purposes. In 1983 the City established park and open space
dedication requirements for residential development within the City, and the
funds received for this purpose were ordained to be placed in the City's Conservation
Trust Fund. During the recent Colorado General Assembly a bill was passed that
prohibited the co-mingling of money in Conservation Trust Funds of each municipality.
In order to comply with new legislation the funds received for parkland dedication
cannot be deposited in the City's Conservation Trust Fund. This amendment will
allow the City to deposit the fees into another fund to be used for the same
original purposes.
In addition the original enactment of the park and open space dedication requirements
inadvertently referred to William Frederick Hayden Park as Hayden Green Mountain
Park. This amendment will also correct that reference.
