ORDINANCE: O-2004-28
SUBJECT: Ordinance Amendment Case Number OA-03-001
Proposed Zoning Ordinance Amendments adding to and making modifications to section 17-2-2 of Article 2 (Definitions and interpretation), adding the use of Animal Day Care and exception procedures to sections 17-5-15 through 17-5-21 (District Regulations) and provisions for the special use permitting process for outdoor animal day care to section 17-6-4 (Special Use Permits):

RECOMMENDATION: Staff recommends approval of this ordinance amendment request. Planning Commission, by a vote of 5-0 at the June 2, 2004 meeting, recommends APPROVAL of this request by the City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood has had the new use of Animal Day Care Facilities proposed within the City since August of 2003. City Staff recognized the need to define the use and provide criteria to review the use for both indoor and outdoor uses. City Council directed staff and Planning Commission to re-evaluate the current Zoning Ordinance with regard to the new use of animal day care facilities in response to a heightened interest in opening animal day cares within the City boundaries. Staff realized that the primary source of concern was outdoor uses associated with animal day care facilities. It was necessary for the City to create a review process for outdoor uses associated with animal day care facilities. With the potential concerns that could arise from outdoor use Staff realized that outdoor animal day care uses should be handled through the public process of Special Use Permitting, SUP.
