AN ORDINANCE
AUTHORIZING THE TRADE OF FIVE (5) SHARES OF MERRITT DITCH COMPANY STOCK AND A 3.6 PERCENT INTEREST IN THE WARD LAKE ASSOCIATION OWNED BY THE CITY OF LAKEWOOD FOR TWO (2) INCHES (TWO FORTIETHS OF ONE SHARE) OF THE AGRICULTURAL DITCH AND RESERVOIR COMPANY OWNED BY ARNOLD L. GREENBERG
WHEREAS, the City of Lakewood (City) owns a 3.6 percent interest in the Ward Lake Association; and,
WHEREAS, the City accepted bids for sale of this 3.6 percent interest and opened bids on April 27, 2004; and,
WHEREAS, one bid only was received, from Arnold L. Greenberg, which offered to trade two (2) inches (two fortieths of one share) of Agricultural Ditch and Reservoir water for the City's 3.6 percent interest in the Ward Lake Association and five (5) shares of the City's Merritt Ditch Company stock; and,
WHEREAS, the Public Works Department and the City's water engineer and water attorney have analyzed this trade and have determined it is equitable for the City,
NOW, THEREFORE, BE IT ORDAINED By The City Council of The City of Lakewood, Colorado, that:
SECTION 1. The City Council hereby authorizes the trade of the City's 3.6 percent interest in the Ward Lake Association and five (5) shares of Merritt Ditch Company stock to Arnold L. Greenberg in return for two (2) inches (two fortieths of one share) of the Agricultural Ditch and Reservoir Company.
SECTION 2. The City Manager is authorized to take all necessary actions to
effect this trade.
SECTION 3. Effective date. This ordinance shall take effect thirty (30) days
after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of June, 2004; published in full in the Lakewood Sentinel on the 1st day of July, 2004; set for public hearing on the 12th day of July, 2004; read, finally passed and adopted by the City Council on the 12th day of July, 2004; and, signed and approved by the Mayor on the 13th day of July, 2004.
