SUBJECT: Annexation Case Number AX-03-001

Annex property from Unincorporated Jefferson County to the City of Lakewood for the existing Colorado Academy campus.

ADDRESS: 3800 South Pierce Street

APPLICANT: Alanna Brown, Colorado Academy

RECOMMENDATION: Staff recommends approval of this annexation request to allow for annexation of the existing Colorado Academy campus and associated rights-of-way. Planning Commission, by a vote of 6-0 at the May 5, 2004 meeting, recommended APPROVAL of this annexation request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: A Petition for Annexation has been filed with the City Clerk and a Resolution finding the petition to be in substantial compliance with the Colorado Revised Statutes and setting the date of the hearing on the annexation was adopted by City Council on April 12, 2004. This statutory hearing was scheduled for May 10, 2004.

As is required by the state statutes, the notice of the statutory public hearing on the proposed annexation before the City Council and the resolution finding the petition to be in substantial compliance with the statutes has been published on four successive weeks in a newspaper of general circulation in the City, the first publication of which was at least thirty (30) days prior to the date set for the hearing.

On May 10, 2004, the City Council conducted a public hearing to determine if the proposed annexation complies with Sections 31-12-104 and 31-12-105, C.R.S. At the conclusion of the public hearing the City Council adopted Resolution 04-52 making certain findings of fact regarding the proposed annexation.

Staff finds that the proposed annexation complies with both the City's Three Mile Plan (which includes the Lakewood Comprehensive Plan) and the Colorado Revised Statutes, and that the proposed annexation would enhance the social and physical continuity of the City and further identify the City's boundaries in the area. First reading of this Ordinance is scheduled for May 10, 2004, and the second reading and public hearing for the annexation and zoning ordinances for the subject property is to be conducted on May 24, 2004.
