ORDINANCE: O-2004-14
SUBJECT: Ordinance granting peace officer status for Court Marshals

RECOMMENDATION: Approve the ordinance

SUMMARY AND BACKGROUND OF SUBJECT MATTER: HB 03-1266 recodified the definitions of peace officer in State of Colorado Statutes. This legislation did not include a definition of peace officer for municipal court marshals. This necessitated a change in Ordinance 2.20.155 Marshals-Authority. This change removed peace officer authority from our court marshals.
HB 04-1218 was introduced by Representative Rob Fairbank and subsequently passed both the Colorado House and Senate with amendments requiring training for court marshals. Governor Owens has signed the bill. Ordinance 2.20.155 must now be amended again to restore peace officer status to the City of Lakewood court marshals.
