SUBJECT: Rezoning Case Number RZ-03-005

Rezone existing property from the 1-C (Convenience Commercial) zone district to the PD (Planned Development) zone district for the purpose of a mixed-use residential and commercial development.

ADDRESS: 1906 South Kipling Street

RECOMMENDATION: Staff recommends approval of this rezoning request to allow for the construction of 45 multi-family residential units and a 10,300-sq.ft. commercial building. Planning Commission, by a vote of 7-0 at the April 7, 2004 meeting, recommended APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant has applied to the City for a rezoning request to rezone the property located at 1906 South Kipling Street from the 1-C (Convenience Commercial) zone district to the PD (Planned Development) zone district. The applicant is requesting the rezoning in order to construct 45 residential condominium units as well as a 10,300-sq.ft. convenience commercial building. The property is approximately 6.06 acres in size. The property is currently undeveloped with the exception of a 5,536-sq.ft. commercial building that is currently vacant. An Official Development Plan (ODP) has been submitted with the rezoning request.

The Planning Commission recommended approval subject to two conditions. Condition 1: The applicant shall provide to the City an error free photo mylar of the Official Development Plan prior to the City Council hearing; and Condition 2: The Public Improvements Agreement be signed and returned to the City prior to this case being scheduled for City Council. These conditions have been met and the case is now ready for City Council action.
