ORDINANCE: 2004-10
SUBJECT: On Street Pay Parking at Belmar.
RECOMMENDATION: City Council adoption of the Ordinance.
FUNDING SOURCE: Revenue from Pay Parking.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The proposed ordinance establishes on street pay parking in certain areas of the Belmar development. The pay parking program was discussed by City Council during Study Sessions on February 2 and February 23. Additional information was provided to City Council by memorandum dated February 6.
Pay parking will be used to enhance the availability of convenient on street parking spaces for customers and visitors intending to remain for short periods of time in the commercial core of Belmar.
The ordinance specifically authorizes pay parking only within the Belmar development. Pay parking is not authorized at any other location by this ordinance. Any potential future expansion of pay parking would require City Council adoption in the future of an additional ordinance.
The main features of the ordinance include:
· The requirement for drivers to pay for parking in designated areas at Belmar during designated times.
· Authorization to delegate Belmar pay parking management to The Plaza Metropolitan District No. 1.
· Authorization for parking enforcement personnel to issue warnings and summonses to violators.
· Creation of a fund to account for pay parking revenue received by the City.
· Authorization for the Municipal Court to utilize a collection process
to recover unpaid judgments.
Second reading of the ordinance is scheduled for April 12, 2004. Council action
on that date will allow pay parking to be in place on the day of Belmar's phase
1 opening, which is scheduled for May 14. The April 12 City Council agenda will
also include a resolution to authorize an intergovernmental agreement with The
Plaza Metropolitan District No. 1 to implement and manage pay parking at Belmar.
