AN ORDINANCE
AUTHORIZING THE CONVEYANCE OF APPROXIMATELY 7,106 SQUARE FEET OF THE WESTLAND TOWNE CENTER PARKING LOT TO WESTFIELD AMERICA, INC. FOR THE PURPOSE OF BUILDING EXPANSION AT 10555 WEST COLFAX AVENUE, FURTHER DECLARING AN EMERGENCY
WHEREAS, Westfield America, Inc. (Westfield), owns retail property located at 10555 West Colfax Avenue which is legally described as Lot 2, Block 1, Westland Towne Center; and,
WHEREAS, the City of Lakewood owns the adjacent parking lot property which is legally described as Lot 15, Block 1, Westland Towne Center Lot Line Adjustment No. 1 Plat (City Property); and,
WHEREAS, Westfield desires to purchase approximately 7,106 square feet of the City Property as described in attached EXHIBIT A (Transfer Parcels); and,
WHEREAS, City desires to sell said Transfer Parcels.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is authorized to sign and the City Clerk is authorized to attest all necessary documents, including but not limited to a Purchase and Sale Agreement, deeds, lot line adjustment plats that are necessary to complete such sale of the Transfer Parcels described in attached EXHIBIT A.
SECTION 2. The revenues for said sale shall be deposited in the City's General Fund.
SECTION 3. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. The expeditious sale of said Parcel is necessary to remain in compliance with the requirements of the Department of Housing and Urban Development.
SECTION 4. This ordinance shall take effect upon the Mayor's signature.
I hereby attest and certify that the within and foregoing ordinance was introduced
and read on first reading at a regular meeting of the Lakewood City Council
on the 23rd day of February, 2004; published in full in the Lakewood Sentinel
on the 26th day of February, 2004; set for public hearing on the 22nd day of
March, 2004; read, finally passed and adopted by the City Council on the 22nd
day of March, 2004; and, signed and approved by the Mayor on the 23rd day of
March, 2004.

Legal Description
A parcel of land being a part of Lot 15, Block 1, WESTLAND TOWNE CENTER LOT LINE ADJUSTMENT NO. 1 PLAT, the plat of which is recorded in Plat Book 123, Pages 36, 37, 38, of the records of the Jefferson County Clerk and Recorder and further lying in the Southeast One-quarter of Section 33, Township 3 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, and being more particularly described as follows:
Commencing at the Southwest corner of Lot 2, WESTLAND TOWNE CENTER, the plat of which is recorded in Plat Book 115, at Pages 53 through 57, inclusive, of said County records, and considering the South line of said Lot 2 to bear N 89º40'42" E with all bearing shown herein related thereto; thence N 89º40'42" E along said South line of Lot 2 and which is in common with a North line of said Lot 15 in which said parcel lies, a distance of 126.17 feet to the True Point of Beginning; thence continuing along said common line N 89º40'42" E, a distance of 57.10 feet; thence S 00º19'18" E, a distance of 21.00 feet; thence S 89º40'42" W, a distance of 57.10 feet; thence N 00º19'18" W, a distance of 21.00 feet to the True Point of Beginning, and said parcel containing and area of 1,199 square feet, more or less.
