AN ORDINANCE
AUTHORIZING AN EASEMENT TO PUBLIC SERVICE COMPANY FOR UNDERGROUND GAS LINE AND ELECTRIC SERVICES AND RELATED FACILITIES FOR THE LAKEWOOD HOUSING AUTHORITY PROPERTY LOCATED AT 1205 QUAIL STREET, LAKEWOOD, COLORADO, FURTHER DECLARING AN EMERGENCY.
WHEREAS, Public Service Company has requested that the City of Lakewood convey to Public Service Company an easement for underground gas line and electric service and related appurtenances for the Lakewood Housing Authority building located at 1205 Quail Street across land owned by the City; and
WHEREAS, the Charter of the City of Lakewood provides, in Section 14.3 thereof, that utility easements may be granted across such land, which the City is willing to do.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest an easement, in form approved by the City Attorney, to Public Service Company across the land described in Exhibit "A" attached hereto and made a part hereof, for underground gas line and electric service and related appurtenances.
SECTION 2. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety by granting the easement for the gas line and electric line for the Lakewood Housing Authority building and allowing the construction of the facility to proceed in a timely manner.
SECTION 3. This ordinance shall take effect upon the Mayor's signature.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 12th day of January, 2004; published in full in the Lakewood Sentinel on the 15th day of January, 2004; set for public hearing on the 26th day of January, 2004; read, finally passed and adopted by the City Council on the 26th day of Janaury, 2004; and, signed and approved by the Mayor on the 27th day of Janauary, 2004.
Exhibit "A"
A parcel of land lying in the Northwest One-quarter (NW¼) of Section 4, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
Beginning at the Southeast corner of Lot 1, Block 2, QUAIL STREET BUSINESS PARK FILING NO. 2, the plat of which is recorded in Plat Book 122, at Page 5, of the records of the Jefferson County Clerk and Recorder; thence S 46º34'38" E (assuming the South line of said Lot 1, bears S 89º03'02" E all other bearings hereafter related thereto) along the southwest line of Parcel 2 as described in that instrument recorded at Reception Number F0399614, of said records, a distance of 117.52 feet, more or less, to the Southwest corner of said Parcel 2, said last corner also being a point on a non-tangent curve; thence southwesterly along the arc of said non-tangent, said curve being to the right and having a radius of 250.00 feet, a central angle of 05º17'39" (whose long chord bears S 73º24'52" W, a long chord length of 23.09 feet) an arc distance 23.10 feet; thence leaving said curve N 46º34'38" W, a distance of 119.86 feet; N 00º56'58" E, a distance of 5.37 feet, more or less, to the South line of said Lot 1; S 89º03'02" E, along said South line, a distance of 23.75 feet, more or less, to the point of beginning. The above described parcel contains an area of 2,442 square feet, more or less.
