Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.
ITEM 1. CALL TO ORDER
Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.
ITEM 3. APPROVAL OF MINUTES
Regular Meeting August 12, 2004
Regular Meeting September 9, 2004
Mr. Wisneski moved to approve the minutes of the regular meetings held on August 12, 2004, and September 9, 2004. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE MINUTES CARRIED.
ITEM 4. NEW APPLICATION
Hotel & Restaurant License
Feather 8, Inc.
d/b/a El 7 Mares
1080 S. Wadsworth Blvd.
Mr. Kennebeck told the Authority this is an existing restaurant that has applied for a liquor license. He said he reviewed the file and all the paperwork appeared to be in order.
Peter Joseph Schaffer, 400 S. Steele St. Denver, appeared before the Authority and was sworn in. He testified he has been an attorney and sports agent for approximately 18 years. Additionally, he has purchased and operated small Mexican restaurants over the past 10 years. He had not had any liquor violations in the past and has recently attended the city's alcohol training program. Mr. Schaffer explained the dining concept for this location.
Kelly Pietrs, 2792 S. Race St., Denver, appeared before the Authority and was sworn in. She testified she is the principal officer of Esquire Petitioning Services and was hired to conduct a survey of the surrounding neighborhood. Ms. Pietrs explained how the survey was conducted and the results of the survey.
In response to questions from the Authority, Mr. Shaffer testified he was aware of this location's past history and assured the Authority that history would not repeat itself. Mr. Schaffer felt that the clientele has changed for the better within the last three months of his involvement. Mr. Schaffer said he has not hired a general manager yet, but the head waitress keeps an eye on things when he's not around.
Vic Lombardi, 3960 W. 44th Ave., Denver, appeared before the Authority and was sworn in. Mr. Lombardi stated his friend was of good moral character and should be approved for the liquor license. He told the Authority he has known Mr. Shaffer for a long time both as a friend and his attorney.
No one else appeared to speak in favor or opposition to this application and the public hearing was closed.
In discussing this application amongst themselves, there was a general concern surrounding the diagram and the area marked for the patio. The concern was there was no fencing and only a tree line to serve as a barrier between the licensed premises and unlicensed area.
Ms. Hansson moved to approve the application for a hotel & restaurant license of Feather 8 Inc., d/b/a El 7 Mares, 1080 S. Wadsworth Blvd., with the condition that a sign stating "No Alcohol beyond this point" be placed at the entrance to the patio until a fence is constructed. The motion was seconded, and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.
ITEM 5. GENERAL BUSINESS
Mr. Kennebeck informed the Authority of the inability of the Finance Department to conduct an audit of the alcohol sales of La Bailerina, L.L.C., d/b/a La Bailerina. From the information received by the Finance Department, the licensee does not use cash registers and the money is put into bags and taken to the bank each day. Mr. Kennebeck told the Authority that per state statute, the books and records of a licensed establishment must be kept in a manner in which the total amount of alcohol sales can be determined by an audit.
Mr. Wisneski moved that a notice be sent to La Bailerina, L.L.C., d/b/a La Bailerina, to appear before the Authority on October 28, 2004, for the purpose of imposing sanctions against the licensee. The motion was seconded, and with those present voting aye, THE MOTION TO SEND NOTICE CARRIED.
ITEM 6. ADJOURNMENT
There being no further business to come before the Authority, Chairman Taake adjourned the meeting at 7:50 p.m.
