REGULAR MEETING OF LAKEWOOD LIQUOR AND
FERMENTED MALT BEVERAGE LICENSING AUTHORITY

June 10, 2004

Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1. CALL TO ORDER

Chairman Taake called the meeting to order at 7:00 p.m.

Also present: Paul Kennebeck, Deputy City Attorney

Full and timely notice of this meeting had been given and a quorum was present.

ITEM 3. CHANGE OF LOCATION APPLICATION

Retail Liquor Store License
Villa Italia Liquors, Inc.
d/b/a Villa Italia Liquors
1460 Carr St.

Mr. Kennebeck explained to the Authority that this retail liquor store license was located in an area being redeveloped by the Urban Renewal Authority for the new Belmar District. The licensee wishes to relocate to another location in Lakewood and must demonstrate to the Authority that he has satisfied the "needs and desires" of the neighborhood.

Nasim Joel, 3460 Lowell Blvd., Denver, appeared before the Authority and was sworn in. He asked the Authority to approve his application for a change in location.

Susan Duffy Schwall, 24 Via Sierra Grande, Manitou Springs, appeared before the Authority and was sworn in. Ms. Schwall testified that she was co-owner of a survey company called Public Opinion who petitioned the neighborhood at the applicant's request. She explained how the survey was conducted and the results of that survey.

There was no one in the audience in favor or opposition to this application and the public hearing was closed.

Mr. Muniz moved to approve the change of location application for Villa Italia Liquors, Inc., d/b/a Villa Italia Liquors, 1460 Carr St. The motion was seconded, and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.

ITEM 4. GENERAL BUSINESS

Mr. Kennebeck explained to the Authority how a continuance was discussed at the last meeting regarding a Show Cause Hearing for La Ballerina, L.L.C., d/b/a La Ballerina. At that time a date could not be set. Even though Mr. Kennebeck has not been able to contact the Police Agent needed to testify, he would like to go forward and set a hearing date.

A date of September, 9, 2004, was set and Laura Bock said she would send a certified letter to the licensee providing him with the hearing date.

Additionally, Mr. Kennebeck told the Authority he had received a phone call from the managing member who asked if he could sell the business while this matter was pending.

Ms. Hansson asked that this matter be discussed at a later meeting when all Authority members are present.

ITEM 5. ADJOURNMENT

There being no further business to come before the Authority, Presiding Chairwoman Hansson adjourned the meeting at 7:30 p.m.
