The following are the minutes of the April 7, 2004 Lakewood Planning Commission Public hearing. A permanent set of these minutes is retained in the office of the City Clerk and a tape recording is located in the department of Community Planning and Development, City of Lakewood.

The roll having been called, a quorum was declared and the following business was
conducted.
CHAIRMAN QUINN explained guidelines to be adhered to.

1. CASE NO. RZ-03-005 Rezoning

KEN PONSARELLI of Land Architects at 9137 S. Ridgeline Blvd., Suite 130, Highlands Ranch, Colorado gave the presentation for rezoning the Lakeview Plaza property at 1906 South Kipling Street from 1-C (Convenience Commercial District) to PD (Planned Development). The basic points of the presentation were: the site context, resent history of the property, surrounding commercial development within the area, how Fairfield Homes became involved with this development, the initial concept plan presented to neighborhood groups, collaborative effort and discussion with neighbors, then the final site plan, community & neighborhood character of the surrounding development and their proposed architectural character and benefit to Lakewood. The Fairfield Homes team present at tonight's public hearing are: Ken Slyziuk, Dick Bakker, Al Gardeny of Fairfield Homes, Developer and Builder; Andrew Gardner of TerraCon, Geo-technical Engineer; Andy Kelly of Martin & Martin, Civil Engineer; Gary Goden of Casey Goden Architects, Architect, and Dave Leahy of TDA Colorado, Traffic Engineer

CHAD MINOR, SENIOR PLANNER, gave the Staff Report. All requirements were met. Thus staff's recommendation was to have Planning Commission recommend that the City Council approve the case subject to the applicant submitting a signed correction free photographic mylar of the ODP before the case is heard at City Council.

Comments from neighbors who could not make the meeting were given by Chad. The first citizen was Marietta Claire, address unknown, who was concerned about the proposed turning movement onto South Kipling Street. She said she would like to see a right in and right out only onto S. Kipling St. but is supportive of the use and development.

Next was Mark Ernest, 10160 W. Asbury St., supportive of development. Only issue was the condition of the property currently and to get the developer to get something going right away.

Third caller was Christopher Hildenbrand, owner of properties at 9640 through 9690 W Jewell Place and also the owner of the properties at 9740 through 9990 W Jewell Place. He is in favor of the project and had no concerns.

There were no citizen's at the meeting who wanted to speak regarding this project.

COMMISSIONER HOLLEN asked that traffic issues be addressed. Applicant's traffic engineer said there was no problem, projecting up to the year 2025.

COMMISSIONER HOLLEN was concerned about vertical mixed-use options. And is there adequate parking for guests? CHAD MINOR answered saying yes.

COMMISSIONER HOLLEN pointed out the difference between staff report saying this is "Rustic French Contemporary" versus "Rustic Contemporary"

COMMISSIONER CHOI mentioned that he has had contact many years ago with Mr. Ken Ponsarelli.
COMMISSIONER CHOI said he thought the spirit of the comp plan were met superbly. Thought it was a job well done.

COMMISSIONER MARINO felt the character of the development was a good addition to Ward 4.

COMMISSIONER URBANOWSKI asked when you have a commercial pad like this, what is the traffic impact on the area? David Leahy answered said they would expect to be about 78 vehicles coming in and 59 going out.

COMMISSIONER URBANOWSKI has had past meetings with the Engineering Company of Martin and Martin but very little contact and nothing that would influence his decision today.

COMMISSIONER LLOYD questioned whether the restriction might have considered the right in and right out onto Jewell. David Leahy answered saying yes they had but this is a "T" street so fewer problems with that. Did the city traffic engineer have any concerns? CHAD MINOR said there were no concerns expressed.

COMMISSIONER URBANOWSKI asked about traffic locations regarding ingress and egress and neighborhood concerns.

CHAD MINOR stated there were no traffic problems with this project. There were two neighborhood meetings and no there were no citizen complaints after the meetings that staff is aware of.

COMMISSIONER QUINN noticed two depressions on the site, were they old detention areas? Ken Ponsarelli said yes, their proposed detention pond would be on the north.

COMMISSIONER HOLLEN voiced concern about the landscaping and CHAD MINOR said with the Article 15 site plan submittal there would be more detail about landscaping.

COMMISSIONER MALM then made the motion to approve RZ-03-005 after having said that she was very impressed with the staff report and the presentation by the developer.

COMMISSIONER MARINO seconded the motion

Motion passed by a vote of 7-0.

2. CASE NO. OA-03-003 RECOMMEND ADOPTION OF THE ALAMEDA OVERLAY ZONE DISTRICT EXTENSION

PALLAVI JHAVERI, Planner III in Strategic Planning Division, explained that the Finding of Facts in the staff report is consistent with the Existing Alameda Overlay Zone, Lakewood Comprehensive Plan, Lakewood Zoning Ordinance and Alameda Cornerstone Plan. Based upon this review, staff recommends approval of this extension.

COMMISSIONER MALM moved to forward a recommendation for approval of Revised Article 21 of the Zoning Ordinance.

COMMISSIONER MARINO seconded the motion.

Motion passed by a vote of 6-0 with Rich Urbanowski abstaining.

COMMISSIONER QUINN said it was an excellent report by Pallavi Jhaveri.

3. OA 03-003 RECOMMEND ADOPTION OF THE FENCE ORDINANCE

SUE PIERCY gave the Staff Report, requesting the Planning Commission forward a recommendation of approval to City Council for the Zoning Ordinance to address fencing. She explained that there have already been meetings to address clarification of terms, fencing materials and locations that can help Code Enforcement Officers work with violation cases and complaints. One component of the ordinance changes is an Amendment to Article 2 to provide some additional definitions, an amendment to Article 5, District Regulations, which provides some change of language, and then to repeal and enact an entirely new article, Article 8, into the Zoning Code.

COMMISSIONER HOLLEN wanted to open the topic of Performance Based Standards exceptions and clarify the role of the Director of Community Planning & Development and his role in making exceptions especially with respect to the Planning Commission and the Board of Adjustment.

Frank Gray, Director of Community Planning & Development responded saying the idea is that all fence types and situations can't be described in an ordinance. When we look at the purpose of a fence, there are Performance Based Standards that are insinuated in those guidelines. We get situations all the time where something just doesn't fit. Then it becomes the Director's judgment call.

COMMISSIONER CHOI said he thought this was incredibly well written and brought up the fact that there was a bar to reach. There does still need to be an agreement for appeal where the Board of Adjustment is on the same page as Planning Commission. He asked for staff to arrange a meeting between the various boards.

COMMISSIONER MARINO wanted to commend staff being the first amendment post-Comp. Plan. Thought this was an excellent step and commended staff for working with commissioners.

COMMISSIONER URBANOWSKI felt this is an incredible piece of work.

COMMISSIONER MALM said this is the first venture into new waters and wanted to commend staff for their patience and perseverance and this document is extremely well done.

COMMISSIONER QUINN said this is a real step forward in terms of introducing the terminology of Performance Based Standards into the Zoning Ordinance. Congratulated staff for their patience and very hard work on this and in sticking with commissioners on this.

SUE PIERCY asked that Chad Minor, Lois Engbretson and Gail Spencer also be recognized for their hard work and their being instrumental in putting these amendments together.

COMMISSIONER MARINO moved to recommend to City Council approval of this ordinance.

COMMISSIONER CHOI seconded.

Motion carried by a vote of 6-0 with COMMISSIONER URBANOWSKI abstaining.

4. APPROVAL OF MINUTES FROM JANUARY 21, 2004 MEETING

COMMISSIONER MARINO moved to approve the Minutes of January 21, 2004, Second by COMMISSIONER LLOYD.

Motion passed by a 5-0 vote with COMMISSIONER HOLLEN and COMMISSIONER URBANOWSKI abstaining.

COMMISSIONER COMMENTS

COMMISSIONER HOLLEN mentioned that she was thrilled to see the City of Lakewood Alameda Cornerstone planning process make it's way into "Supurbia", a book on suburban revitalization and sustainability, whose publisher is Mother Earth.

GENERAL BUSINESS

There being no other business to come before the Lakewood Planning Commission, the public hearing of April 7, 2004 was adjourned at 8:05 p.m.
