ITEM 1 - CALL TO ORDER

Mayor Burkholder called the meeting to order at 7:00 p.m. in the Council Chambers, Lakewood Civic Center South, 480 South Allison Parkway, Lakewood, Colorado.

Full and timely notice of this City Council meeting had been given and a quorum was present.

ITEM 3 - PLEDGE OF ALLEGIANCE

In honor of Armed Forces Day, the Presentation of Colors was performed by officers from the US Army, US Air Force, US Navy, and US Marine Corps. The Pledge of Allegiance was recited.

ITEM 4 - PROCLAMATION - MENTAL HEALTH MONTH

Mayor Burkholder proclaimed May 2004 "Mental Health Month" in the City of Lakewood and urged residents to recommit the community to increasing awareness and understanding of mental illness and the need for appropriate and accessible services for all people with mental illness.

ITEM 5 - PUBLIC COMMENT

Michael O'Beirne - P.O. Box 260313 - Lakewood, Colorado 80226
Mr. O'Beirne asked City Council to look at the property located at Florida and Alameda owned by Mr. Todd. It is the last remaining parcel of land in the ravine that connects Bear Creek and Green Mountain. He also asked Council to support energy-efficient construction of Jefferson County school buildings should the bond election pass in November.

The following Consent Agenda items were read into the record by the City Clerk:

ITEM 6 - RESOLUTION 2004-49 - AUTHORIZING THE CITY OF LAKEWOOD TO ENTER INTO AN AGREEMENT WITH THE CITY OF GOLDEN

ITEM 7 - RESOLUTION 2004-50 - AUTHORIZING THE ASSIGNMENT OF $5,766,000 OF THE CITY'S PRIVATE ACTIVITY BOND ALLOCATION FOR 2004 TO THE HOUSING AUTHORITY OF THE CITY OF LAKEWOOD; PROVIDING OTHER DETAILS IN CONNECTION THEREWITH; AND PROVIDING AN EFFECTIVE DATE

ITEM 8 - RESOLUTION 2004-51 - REQUESTING REIMBURSEMENT FROM, AND CERTIFYING EXPENDITURES TO, JEFFERSON COUNTY OPEN SPACE FOR DEVELOPMENT EXPENDITURES AT BEAR CREEK LAKE PARK FOR THE PERIOD COMMENCING FROM APRIL 1, 2003 THROUGH APRIL 30, 2004

ITEM 9 - RESOLUTION 2004-52 - MAKING CERTAIN FINDINGS OF FACT REGARDING THE PROPOSED ANNEXATION OF A PARCEL OF LAND BEING A PORTION OF THE NORTHWEST ONE-QUARTER OF SECTION 1, AND A PORTION OF THE NORTHEAST ONE-QUARTER OF SECTION 2, TOWNSHIP 5 SOUTH, RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN, COUNTY OF JEFFERSON, STATE OF COLORADO, TO BE IN SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31-12-107(1)

ITEM 10 - RESOLUTION 2004-53 - AUTHORIZING THE CREATION OF THE LAKEWOOD YOUTH ADVISORY COMMISSION AND APPOINTING MEMBERS THERETO

ITEM 11 - RESOLUTION 2004-54 - SUPPORTING THE RENEWAL OF THE SCIENTIFIC AND CULTURAL FACILITIES DISTRICT FUNDING

ITEM 12 - RESOLUTION 2004-55 - APPROVING THE FIRST AMENDMENT TO THE AMENDED AND RESTATED CONSOLIDATED SERVICE PLAN FOR THE PLAZA METROPOLITAN DISTRICT NO. 1, THE PLAZA METROPOLITAN DISTRICT NO. 2, AND THE PLAZA METROPOLITAN DISTRICT NO. 3.

ITEM 13 - ORDINANCE O-2004-14 - AMENDING THE LAKEWOOD MUNICIPAL CODE, SECTION 1.04.010 RELATING TO THE DEFINITION OF PEACE OFFICER AND SECTION 2.20.155 RELATING TO THE AUTHORITY OF COURT MARSHALS; FURTHER DECLARING AN EMERGENCY

ITEM 14 - ORDINANCE O-2004-16 - ANNEXING CERTAIN UNINCORPORATED LANDS IN A PORTION OF THE NORTHWEST ONE-QUARTER OF SECTION 1, AND A PORTION OF THE NORTHEAST ONE-QUARTER OF SECTION 2, TOWNSHIP 5 SOUTH, RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN, COUNTY OF JEFFERSON, STATE OF COLORADO (COLORADO ACADEMY)

ITEM 17 - ACCEPTING MINUTES OF BOARDS AND COMMISSIONS

Lakewood Senior Citizen Advisory Commission Meeting March 10, 2004

It was stated that the public comment portion of the Consent Agenda would also act as the public hearing on Resolution 2004-52 and Resolution 2004-55.

Roger Noonan stated that the Petition for the Annexation referenced in Resolution 2004-52 is in substantial compliance with the state statutes; that public notices have been published for four successive weeks; and the proper notification of Jefferson County officials and other Special Districts has been completed by the City Clerk's Office.

Public Comment: None

Councilman Elliott made a motion to approve the Council minutes; to accept the minutes of Boards and Commissions; and ordered all ordinances introduced on first reading to be published in the Lakewood Sentinel with public hearing set for the date included in the ordinance; and ordered the adoption of resolutions, all of which were included in the Consent Agenda items introduced into the record by the City Clerk. Councilwoman Wise seconded the motion.

Councilwoman Herbst showed a video presentation of a local television news spot highlighting the Lakewood Youth Commission and their involvement in Lakewood's skateboard parks.

Vote on the Consent Agenda: All Ayes. No Nays. The motion carried.

ITEM 18 - ORDINANCE O-2004-12 - TO REZONE LAND LOCATED AT 1906 SOUTH KIPLING STREET, CITY OF LAKEWOOD, JEFFERSON COUNTY, COLORADO

Alec Martini, 10789 Brandford Road, Littleton, Colorado stated that he represented the Applicant and he and others were available to answer questions.

Chad Minor, Lakewood Senior Planner, stated that the application had been reviewed by staff and staff was recommending approval. He stated that the Planning Commission recommended approval by a vote of 7-0.

Public Comment: None

Councilman Elliott made a motion to adopt Ordinance O-2004-12 on second and final reading. Councilwoman Wise seconded the motion.

Vote: All Ayes. No Nays. The motion carried.

ITEM 19 - ORDINANCE O-2004-13 - AMENDING SECTIONS 17-21-2 (1), 17-21-2 (2), and 17-21-12 OF THE LAKEWOOD ZONING ORDINANCE PERTAINING TO THE ALAMEDA OVERLAY ZONE DISTRICT

Public Comment: None

Councilman Elliott made a motion to adopt Ordinance O-2004-13 on second and final reading. Councilwoman Wise seconded the motion.

Vote: All Ayes. No Nays. The motion carried.

ITEM 20 - GENERAL BUSINESS

Councilman Elliott made a motion to hold a Special Meeting on May 17, 2004 at 5:00 p.m., for the purpose of holding an Executive Session to discuss personnel matters, in particular, citywide compensation benefits and related issues, per C.R.S. 24-6-402(4)(f) and 2.15(c)(8) of the Lakewood Home Rule Charter. It was seconded by Councilwoman Wise. Vote: All Ayes. No Nays. The motion carried.

ITEM 21 - REPORTS

City Council reported on their attendance at various meetings and events and announced upcoming events and meetings.

ITEM 22 - ADJOURNMENT

There being no further business to come before the Council; Mayor Burkholder adjourned the meeting at 7:38 p.m.
