REGULAR MEETING OF LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE LICENSING AUTHORITY

February 26, 2004

Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1. CALL TO ORDER

Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.

ITEM 3. SHOW CAUSE HEARING

Tavern License
JHTW, Inc.
d/b/a Whiskey Bills
7290 W. Colfax Ave.

Deputy City Attorney Paul Kennebeck explained to the Authority that this complaint was the result of alcohol service after hours. C.R.S. 12-47-901(5)(b)(I) allows alcohol service for a Tavern License between 7:00 a.m. and 2:00 a.m. On December 1, 2003, at approximately 6:25 a.m. police agents discovered patrons in the bar and drinking alcohol. Mr. Kennebeck said he has talked to the owner about this matter, who will stipulate to the violation.

Tom Wilmering, PO Box 3096, El Dorado Springs, CO, appeared before the Authority and was sworn in. He said he would stipulate to the violation.

Mr. Wisneski moved that the stipulation between the City Attorney and JHTW, Inc., d/b/a Whiskey Bills be accepted for the Tavern License at 7290 W. Colfax Ave. The motion was seconded and with those present voting Aye, THE MOTION TO ACCEPT THE STIPULATION CARRIED.

Mr. Wilmering testified he had purchased the bar last year with a partner whose responsibility was the day-to-day management. He said he is currently trying to remove this partner and take a more proactive role in managing this business. Both the bartender and waitress involved in this incident have both terminated their employment with this license. Mr. Wilmering stated that all employees have now attended the City's Alcohol Awareness Training Program.

Public Testimony was closed.

Ms. Hansson moved the following penalty be imposed: a suspension of five days with four days held in abeyance for one year commencing February 27, 2004. The balance of the suspension to begin at 7:00 a.m. on February 27, 2004, and end at 7:00 a.m. February 28, 2004. The motion was seconded and with those present voting Aye, THE PENALTY MOTION CARRIED.

Mr. Wilmering asked the Authority to allow him to pay a fine in lieu of the one-day suspension.

Ms. Stevens moved to allow JHTW, Inc., d/b/a Whiskey Bills to pay a fine in lieu of suspension. The motion was seconded and with those present voting Aye, THE MOTION TO PAY A FINE IN LIEU OF SUSPENSION CARRIED.

ITEM 4. GENERAL BUSINESS

There was no general business to be discussed.

ITEM 5. ADJOURNMENT

There being no further business to come before the Authority, Chairman Taake adjourned the meeting at 7:20 p.m.
