Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.
ITEM 1. CALL TO ORDER
Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.
ITEM 3. APPROVAL OF MINUTES
Regular Meeting January 22, 2004
Mr. Wolfe moved to approve the minutes of the regular meeting held January 22,
2004. The motion was seconded and with those present voting Aye, THE MOTION
TO APPROVE THE MINUTES CARRIED.
ITEM 4. MODIFICATION OF PREMISES
Hotel & Restaurant License
Francisco Silva
d/b/a Las Cazuelas Restaurant
6757 W. Mississippi Ave
Francisco Silva, 6757 W. Mississippi Ave., appeared before the Authority and
was sworn in. He told the Authority that he wished to expand his restaurant
into the unit next to his by putting in an archway between the two units. The
expansion would allow him to have a smoking section. Mr. Silva testified that
he collected the signatures on the petition submitted to the City by going around
the neighborhood.
Attorney Carmen Beery stated that she had no remarks or comments regarding this
matter.
Mr. Wolfe moved to approve the modification of premises for Francisco Silva, d/b/a Las Cazuelas Restaurant, 6757 W. Mississippi Ave. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE MODIFICATION CARRIED.
ITEM 5. SHOW CAUSE HEARING

White Lodging Services, Inc.
d/b/a Courtyard by Marriott
7180 W. Hampden Ave.
Attorney Carmen Beery testified that this proceeding was initiated by a complaint issued in October 2003. In September 2003, the Liquor Inspector discovered, during the course of her inspection, that the licensee was not meeting the 25% food requirement of a hotel & restaurant license. The goal of the City is to bring this licensee into compliance rather than punish them. Therefore, the City has discussed a stipulation with the licensee's attorney. The stipulation would require the licensee to provide the City with a certified monthly report of their food and beverage sales for the next six months. After the six-month time period, the licensee would again appear before the Authority, and if they have shown that they are in compliance with the 25% food requirement, the complaint would be dismissed.
Dan Carr, registration #8224, appeared before the Authority on behalf of the licensee and stated the licensee has come into compliance and would agree to the proposed stipulation.
Ms. Hansson moved that the stipulation between the City Attorney and White Lodging Services, Inc., d/b/a Courtyard by Marriott be accepted for the hotel & restaurant license at 7180 W. Hampden Ave., and the hearing will be continued to a date certain of July 22, 2004. The motion was seconded and with those present voting Aye, THE MOTION TO ACCEPT THE STIPULATION CARRIED.

Due to a possible conflict of interest, Mr. Wolfe recused himself from the remainder of the meeting.
Joe Heeb, 24994 Simmons Wy., appeared before the Authority and was sworn in. He told the Authority that when he originally submitted his diagram of the licensed premises, he inadvertently omitted large areas such as storage and part of the bar. To include these areas, involves a modification of approximately 50%. Mr. Heeb asked the Authority to waive their regulation requiring the applicant to show the neighborhood needs and desires for modifications involving 20% or more. He just did that by petitions when applying for the license a few months ago.
Mr. Wisneski moved to waive the survey requirement for the modification or premises application for the hotel & restaurant license of Walaroos Holdings, L.L.C., d/b/a Wallaroos Fresh Grill, 11353 W. Colfax Ave. The motion was seconded and with those present voting Aye, THE MOTION TO WAIVE THE SURVEY CARRIED.
ITEM 7. ADJOURNMENT
There being no further business to come before the Authority, Chairman Taake adjourned the meeting at 7:45 p.m.
