Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.
ITEM 1. CALL TO ORDER
Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.
ITEM 3. NEW APPLICATION
Hotel & Restaurant License
Ole & Che Restaurant, L.L.C.
d/b/a Ole Che Restaurant
5800 W. Alameda Ave.
Secretary Laura Bock told the Authority she had received a letter from the applicant
on January 7, 2004, requesting a continuance. The request was granted and the
new hearing date is February 12, 2004.
ITEM 4. NEW APPLICATION
3.2% Off Fermented Malt Beverage License
City Mart, Inc.
d/b/a City Mart
3457 S. Wadsworth Blvd.
Attorney Tammy Russell said she had reviewed the application, as did Attorney Paul Kennebeck, and both agreed that the application appears to be in order.
Richard Mishkin, registration #3805, appeared on behalf of the applicant. Mr. Mishkin said the property for the licensed premises has been purchased by the applicant; therefore, establishing right of possession. He stated that one of the corporate officers has had significant experience in the liquor industry.
Kelly Pietrs, 2792 S. Race St., Denver, appeared before the Authority and was sworn in. She testified that her company was contacted to perform the needs and desires survey of the neighborhood. Ms. Pietrs explained to the Authority how the survey was conducted and the results of that survey.
Leon Finklestein, 8582 E. Iowa Pl., Denver, appeared before the Authority and was sworn in. Mr. Finklestein testified that he has been in operation for 6 months and has had numerous requests for beer. He said he has held other liquor licenses in the state and never received a violation. He will act as full-time manager and trains his employees in-house.
Burton Seiden, 6 S. Tamarac, Denver, appeared before the Authority and was sworn in. He testified that he is a managing partner of a store in the neighborhood and has seen a tremendous improvement to City Mart since the new owners have taken over. He stated that he does consume alcohol on occasion and would like to see this license granted.
Milojka Balorda, 3345 S. Ammons St., appeared before the Authority and was sworn in. She testified that she resides in the neighborhood and purchases alcohol on occasion. She also testified that her husband works for the applicant but if this license is granted, it would not have any bearing on her husband's employment status. Ms. Balorda stated that there was a need for this license to be granted.
Chris Catamach, 7844 W. Mansfield Pkwy., appeared before the Authority and was sworn in. He testified that he is a resident of the neighborhood, consumes alcohol on occasion, and would like to see this license granted.
Attorney Mishkin presented a letter to the Authority from Josh Wishart, a resident in the neighborhood, in favor of the license being granted.
The letter was entered as licensee's exhibit #1.
No one appeared in opposition to the application.
Public testimony was closed.
Mr. Williams moved to approve the 3.2% Off Premise Fermented Malt Beverage License application of City Mart, Inc., d/b/a City Mart, 3457 S. Wadsworth Blvd. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.
ITEM 5. NEW APPLICATION
Tavern License
Sodexho America, L.L.C.
d/b/a Qwest
3898 S. Teller St.
Attorney Tammy Russell said she had reviewed the application, as did Attorney Paul Kennebeck, and both agreed that the application appears to be in order.
Jean Ashack, 1714 Ridgecrest Dr., Loveland, appeared before the Authority and was sworn in. She testified that she works for Sodexho Conferencing Service and is the general manager for this location. Ms. Ashack said Sodexho is a nationwide business providing lodging and meeting rooms to public and private businesses. She has 23 years in the hospitality business and has attended Lakewood's Alcohol Awareness Training. Ms. Ashack plans to send all employees to the training also. Sodexho is seeking a tavern license to offer an additional service to their clients. Their customers would primarily be corporate employees attending conferences or training; however; the tavern would be open to the public for conferences, catering, and meetings.
Ms. Ashack explained that the representative from Oedipus was not there because he had a medical issue.
Chairman Taake asked Attorney Russell if there was a problem with not having testimony from the petition company.
Attorney Russell said it was up the Authority to determine that. If the information is in the packets, and the Authority feels there are discrepancies in the information provided, then the Authority may wish to continue the hearing until someone from the petition company can appear to make clarifications. If the Authority feels the petitions are alright as submitted, they may accept them.
The Authority discussed the issue and felt that since the petitions included Affidavits by the circulators, and no discrepancies were apparent, they would accept the petitions.
No one appeared in opposition and public testimony was closed.
Mr. Willims moved to approve the Tavern License application of Sodexho, America, L.L.C., d/b/a Qwest, 1395 S. Sheridan Blvd. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.
ITEM 6. GENERAL BUSINESS
There was no general business.
ITEM 7. ADJOURNMENT
There being no further business to come before the Authority, Chairman Taake adjourned the meeting at 7:50 p.m.
