RESOLUTION: 2003-81
SUBJECT: Revocable license agreement to allow a 2-foot tall retaining wall along and irrigation piping across the Urban Street right-of-way.
ADDRESS: Across from 12001 W. Colfax Avenue.
RECOMMENDATION: Approve the revocable license agreement
FUNDING SOURCE: Application fee.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The developer proposes to develop 15 residential lots and one commercial lot (Lot 16) on vacant property on the north side of Colfax Avenue. Urban Street will be constructed from Colfax Avenue, north into the property. Access for the new commercial lot on the east side will be from Urban Street while access to the existing commercial lot on the west side of Urban Street will continue to be from Colfax Ave. The grade requirements for the road will result in a difference in elevation between Urban Street and the existing commercial lot on the west side creating the need for the retaining wall on the west side of the right-of-way. The responsibilities for maintaining the wall will be placed with Lot 16. The license agreement would include a conduit under Urban Street to allow for this area to be irrigated from Lot 16.
