A RESOLUTION

AUTHORIZING THE EXPENDITURE OF FUNDS FOR LEASING CITY MULTI-FUNCTIONAL COPIERS AND APPROVING ENTERING INTO A SINGLE SOURCE SERVICE AGREEMENT WITH XEROX CORPORATION

WHEREAS, Section 3.04.070 of the Lakewood Municipal Code requires that any purchase costing $50,000 or more which is not acquired through a competitive bid process be approved by City Council; and

WHEREAS, Section 3.04.090 of the Lakewood Municipal Code requires any unbudgeted purchase over $50,000 shall require approval by City Council; and

WHEREAS, the City is currently at the end of a five-year lease agreement with Xerox for (53) multi-functional and stand-alone copiers; and

WHEREAS, Xerox Corporation has agreed to provide the City with multi-functional copiers, which copy, fax, and print, all in one unit, as part of a new five-year services lease agreement, with an annual appropriations clause required by law; and

WHEREAS, Xerox Corporation and City Staff have reviewed the requirements for fifty-four (54) multi-functional units to be located at the Civic Centers, Public Safety Center, and all off-site City facilities to upgrade and replace older machines at no additional annual costs to the City.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City is hereby authorized to enter into a single source agreement with Xerox for multi-functional copiers.

SECTION 2. The City is hereby authorized to appropriate funds not to exceed $338,000 from the City's General Fund.

SECTION 3. The City Manager is authorized to execute and the City Clerk to attest an agreement, in form approved by the City Attorney, related to the project set forth above.

SECTION 4. This Resolution shall be in full force and effect upon its passage and approval.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on September 22, 2003, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
