A RESOLUTION
AUTHORIZING A REVOCABLE LICENSE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND TOTAL LONGTERM CARE INC., ALONG THE NORTH SIDE OF THE WEST ALAMEDA AVENUE RIGHT-OF-WAY ADJACENT TO THE PROPERTY LOCATED AT 8405 WEST ALAMEDA AVENUE, TO ALLOW PLACEMENT AND MAINTENANCE OF TWO LIGHTED IDENTIFICATION SIGNS AND RELATED APPURTENANCES FOR THE TOTAL LONGTERM CARE WEST CENTER.
WHEREAS, Total Longterm Care Inc. has requested a Revocable License Agreement
from the City of Lakewood to allow placement of a lighted identification sign
and related appurtenances for the Total Longterm Care West Center, on land
owned by the City as a portion of the right-of-way for West Alameda Avenue
in a location just East of the intersection of South Cody Street and West
Alameda Avenue and West of the intersection of South Carr Street and West
Alameda Avenue; and
WHEREAS, the City wishes to allow said use of the portion of said street right-of-way
as described in Exhibit "A" attached hereto and made a part hereof,
for installation, maintenance and replacement of two lighted identification
signs in accordance with the terms and conditions of a Revocable License Agreement
issued by the City.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Revocable License Agreement between the City of Lakewood and Total Longterm Care Inc., in form approved by the City Attorney, for the use described above of the City-owned street right-of-way described in Exhibit "A" hereto.
INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on September 22, 2003, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.

A parcel of land lying in the Southeast One-quarter (SE¼) of Section 10, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
Beginning at the Southeast Corner of said SE¼; thence S 89º45'04" W along the South line of said SE¼ (assumed bearing all other bearings hereafter related thereto), a distance of 74.88 feet; thence N 00º14'56" W, a distance of 12.96 feet to the True Point of Beginning; thence S 89º45'04" W, a distance of 10.00 feet; thence N 00º14'56" W, a distance of 17.04 feet, more or less, to the South line of Lot 25, WEST ALAMEDA HEIGHTS, BLOCK 9 LOT LINE ADJUSTMENT NO 1 PLAT, the plat of which is recorded in Plat Book 169, at Page 38, of the records of the Jefferson County Clerk and Recorder; thence N 89º45'04" E along said South line, said South line being in common with the North right-of-way line of West Alameda Avenue, a distance of 10.00 feet; thence S 00º14'56" E, a distance of 17.04 feet, more or less to the True Point of Beginning, TOGETHERWITH a parcel of land described as follows:
Beginning at the Southeast Corner of said SE¼; thence S 89º45'04" W along the South line of said SE¼, a distance of 269.21 feet; thence N 00º14'56" W, a distance of 13.41 feet to the True Point of Beginning; thence S 89º45'04" W, a distance of 10.00 feet; thence N 00º14'56" W, a distance of 16.59 feet, more or less, to the South line of said Lot 25; thence N 89º45'04" E along said South line, a distance of 10.00 feet; thence S 00º14'56" E, a distance of 16.59 feet, more or less to the True Point of Beginning, the above described parcels contain a combined area of 136 square feet, more or less.
