A RESOLUTION

AUTHORIZING COLLECTION OF STORMWATER PERMIT FEES CURRENTLY COLLECTED BY THE STATE OF COLORADO FROM SPECIFIC CONSTRUCTION SITES WITHIN THE CITY OF LAKEWOOD.

WHEREAS, Section 14.21.090 of the Lakewood Municipal Code requires that any new grading permit fees must be approved by City Council; and

WHEREAS, the City currently performs plan review, inspection and enforcement of erosion control associated with grading on sites within the City; and

WHEREAS, the Colorado Department of Public Health and Environment currently collects a fee for plan review, inspection and enforcement of erosion control associated with grading sites less than five acres and more than one acre in size; and

WHEREAS, the City intends to request delegation of this program to the City of Lakewood.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to accept delegation from the state of the erosion control program for sites greater than one acre and smaller than five acres.

SECTION 2. The City Manager is hereby authorized to collect a fee for the program equal to the amount collected by the state and deposit the fee in the Stormwater Management Utility Fund.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on September 8, 2003 at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
