A RESOLUTION

FOR ACCEPTANCE OF BID AND AUTHORIZING CONTRACT FOR THE UNION BOULEVARD PAVEMENT RECONSTRUCTION PROJECT, ALAMEDA AVENUE TO 6TH AVENUE.

WHEREAS, by Invitation of Bid No. 2399, the City of Lakewood advertised for bids for the Union Boulevard Pavement Reconstruction Project, Alameda Avenue to 6th Avenue and bids were opened on April 24, 2003.

WHEREAS, the lowest responsible bidder has been determined to be Brannan Sand and Gravel, which has submitted its bid in the amount of Two Million Five Hundred Sixty One Thousand Eight Hundred Forty Six and 69/100 ($2,561,846.69) pursuant to the City specifications and instructions, and the City desires to accept the bid of said bidder.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The bid of Brannan Sand and Gravel for the Union Boulevard Pavement Reconstruction Project, Alameda Avenue to 6th Avenue as described in Invitation to Bid No. 2399 is hereby accepted according to specifications as delineated in the Invitation to Bid.

SECTION 2. The City Manager is hereby authorized to execute, and the City Clerk to attest, a contract with the said contractor in form approved by the City Attorney in the total amount of Two Million Five Hundred Sixty One Thousand Eight Hundred Forty Six and 69/100 ($2,561,846.69). The City Manager is hereby further authorized to execute change orders to said contract, in form approved by the City Attorney, which shall not exceed, in the aggregate, an additional ten percent (10%) of the contract or Two Hundred Fifty Six Thousand One Hundred Eighty Four and 67/100 ($256,184.67) for a total contract amount not to exceed Two Million Eight Hundred Eighteen Thousand Thirty One and 36/100 ($2,818,031.36).

SECTION 3. The City Treasurer is hereby authorized to make payment to Brannan Sand and Gravel in accordance with the terms of said contract.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on May 12, 2003, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
