A RESOLUTION

AUTHORIZING A REVOCABLE LICENSE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND STEPHEN M. LYONS, ALONG THE NORTHERLY RIGHT-OF-WAY LINE OF SOUTH FOOTHILLS DRIVE ADJACENT TO THE PROPERTY LOCATED AT 959 SOUTH FOOTHILL DRIVE, TO ALLOW PLACEMENT AND MAINTENANCE OF AN EXISTING RETAINING WALL AND LANDSCAPING IMPROVEMENTS

WHEREAS, Stephen M. Lyons, has requested a Revocable License Agreement from the City of Lakewood to allow for an existing retaining wall and landscaping improvements on land owned by the City as a portion of South Foothills Drive; and

WHEREAS, the City wishes to allow said use of the portion of said street right-of-way as described in Exhibit "A" attached hereto and made a part hereof, for installation, maintenance and replacement of the existing retaining wall and landscaping improvements in accordance with the terms and conditions of a Revocable License Agreement issued by the City.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Revocable License Agreement between the City of Lakewood and Robert E. Martin, in form approved by the City Attorney, for the use described above of the City-owned street right-of-way described in Exhibit "A" hereto.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council on March 24, 2003 at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.

Description of licensed area

A parcel of land lying in the Southwest one-quarter (SW¼) of Section 18, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

That portion of the South Foothills Drive right-of-way lying between the back of the sidewalk and the southeasterly property line of the following described adjacent property:

Commencing at the western most corner of Block 8, GREEN MOUNTAIN ESTATES, the plat of which is recorded in Plat Book 21, at Pages 52 and 53, of the records of the Jefferson County Clerk and Recorder, said western most corner being in common with the western most corner of Block 12, said GREEN MOUNTAIN ESTATES; thence N 28º22'53" E along the northwesterly line of said Block 8, a distance of 398.49 feet, more or less, to an angle point is said northwesterly line; thence continuing along said northwesterly line N 69º47'53" E, a distance of 242.0 feet to the True Point of Beginning; thence at right angles with said northwesterly line S 20º12'07" E, a distance of 110 feet, more or less, to the northwesterly right-of-way line of South Foothill Drive as shown and platted on said GREEN MOUNTAIN ESTATES; thence N 69º47'53" E along said right-of-way line, a distance of 114.40 feet, more or less, to an angle point at the intersection of said right-of-way line; thence continuing along said right-of-way line N 09º06'53" E, a distance of 32.00 feet, thence leaving said right-of-way line N 64º40'03" W, a distance of 114.57 feet, more or less, to an angle point on the northwesterly line of said Block 8; thence S 69º47'53" W along said northwesterly line, a distance of 50.00 feet, more or less, to the True Point of Beginning, EXCEPT that portion of the above described adjacent property that lies within the South Foothills right-of-way that lies southeasterly of the 15.00 foot radius curve at the southeast corner of said adjacent property.
