ORDINANCE: 2003-27
SUBJECT: Ordinance vacating a portion of West Mississippi Avenue right-of-way adjacent to 5440 West Mississippi Avenue, City of Lakewood, County of Jefferson, State of Colorado.
ADDRESS: 5440 West Mississippi Avenue.
RECOMMENDATION: Adoption of the attached ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: In 2002, the City of Lakewood completed acquisition of necessary rights of way and easements for the West Mississippi Avenue improvement project between South Sheridan Boulevard and South Pierce Street. Prior to these acquisitions, the Jefferson County Assessor's maps indicated that the right of way adjacent to 5440 W. Mississippi Avenue was 38 feet wide, but no deed conveying this interest could be found. In an agreement between the property owner and the City, the property owner would quit claim 32 feet to the City with the understanding that the City would vacate the remaining 6 feet, which would then go to the property owner. Notices of the proposed vacation have been sent to all the utility companies; Xcel Energy has requested that the City reserve the vacated right-of-way for their existing utilities, which is reflected in the vacation ordinance. Staff has reviewed this request and recommends that this request be approved.
