ORDINANCE: O-2003-25

SUBJECT: Ordinance correcting the written legal description of the property to be included within the Alameda Corridor Business Improvement District and reflective of the boundary map as was recorded at the Jefferson County Recorder's Office. The map is correct and the legal description has been corrected.

RECOMMENDATION: Staff recommends approval of this ordinance to correct the Alameda Corridor Business Improvement District legal description.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: On July 28, 2003 the City Council passed and adopted an ordinance that organized the Alameda Corridor Business Improvement District (BID). The legal description that described the boundary and the property within the boundary of the BID inadvertently included the south 113 feet of 433 South Allison Parkway (Lot 5 Belmar Plaza Subdivision Lot Line Adjustment No. 1 Plat). The map of the BID boundary excluded all of 433 South Allison Parkway. The map is correct and the legal description is to be corrected to be reflective of the map. The inclusion of 433 South Allison Parkway was a result of using the legal description of the Lakewood City Commons property, which originally included the 113 feet of property, before it became 433 South Allison Parkway. Soon after the Lakewood City Common's subdivision, 433 South Allison Parkway went through a subdivision of property. There was an oversight in recognizing the new subdivision of property when creating the BID legal description.
