AN ORDINANCE

AMENDING THE DESCRIPTION OF PROPERTY INCLUDED WITHIN THE ALAMEDA CORRIDOR BUSINESS IMPROVEMENT DISTRICT, AND DECLARING AN EMERGENCY.

WHEREAS, on July 28, 2003, the City Council passed and adopted Ordinance No. O-2003-18 organizing the Alameda Corridor Business Improvement District (the "District") along portions of the West Alameda Avenue corridor in the City pursuant to 31?25?1201, et seq., C.R.S.; and

WHEREAS, the legal description of property included within the District attached to and incorporated into said Ordinance as Exhibit A inadvertently included portions of a parcel of real property having street address of 433 South Allison Parkway, no part of which parcel was intended by the proponents of the District, the City Council or the owners of said property to be included in the District; and

WHEREAS, the area involved is less than one acre in size and its inadvertent inclusion in the legal description of the District had no material effect upon the legal sufficiency of the petition for the organization of said District; and

WHEREAS, Exhibit A attached to this Ordinance and incorporated herein by reference is the correct legal description of the property intended and desired by all interested parties to be included in the District; and

WHEREAS, the governing bodies of the City and the District, and the owner of the inadvertently included property desire to correct the error in said legal description;

NOW, THEREFORE, BE IT ORDAINED By The City Council of The City of Lakewood, Colorado, as follows:

SECTION 1. The above and foregoing recitals are incorporated herein by reference and are adopted as findings and determinations of the City Council.

SECTION 2. Ordinance No. O-2003-18 is amended by substituting Exhibit A attached to this Ordinance for the Exhibit A attached to the said Ordinance No. O-2003-18, with the intent that Exhibit A attached to this Ordinance be regarded and treated for all purposes, including taxation, as the correct legal description of the District.

SECTION 3. By reason of the fact that the Jefferson County assessor's office is required by state law to determine and certify to the District its total assessed valuation for purposes of taxation and needs to have the correct legal description of the District for such purposes at the earliest possible time, the City Council finds and declares that an emergency exists and that this Ordinance is necessary to the immediate preservation of the public peace, health, or safety.

SECTION 4. This ordinance shall take effect upon the signature of the Mayor.

The foregoing legal description is a general boundary description, which was not based on a survey, for the Alameda Corridor Proposed Business Improvement District. This legal was based on the boundary map of the Alameda Corridor Proposed Business Improvement District, the above mentioned subdivision plats and the Jefferson County Assessor Parcel Maps.
