ORDINANCE: O-2003-22
SUBJECT: Authorizing the conveyance of Remainder Property acquired for road improvements to the Lena Gulch Metropolitan District.

RECOMMENDATION: Approve the Ordinance
FUNDING SOURCE: All property acquisitions in this area were paid for by the Lena Gulch Metropolitan District.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: In 1996, the City Council approved Ordinance O-96-33 which authorized staff to acquire certain property rights in the area bounded by West 20th Avenue on the North, Youngfield Street on the east, West 4th Avenue on the south, and a line 3000 feet northwesterly of Interstate-70 for road improvements and other public purposes. Some of the acquisitions in this area required the acquisition of entire properties due to the impacts on the existing structures even though only a part of the property was needed for the improvements.
In 2001 the City entered into an agreement with the Lena Gulch Metropolitan District whereby the City staff would acquire all necessary property interests and the District would pay all costs of acquisition. That agreement states that the City would convey all Remainder Property to the District. An ordinance is required to grant the City Manager the authorization to sign these deeds.
