AN ORDINANCE
AUTHORIZING THE CONVEYANCE OF REMAINDER PARCELS WHICH WERE ACQUIRED FOR ROAD AND OTHER PUBLIC IMPROVEMENTS TO THE LENA GULCH METROPOLITAN DISTRICT, FURTHER DECLARING AN EMERGENCY
WHEREAS, IN 1996 the Lakewood City Council adopted Ordinance O-96-33 authorizing the acquisition of property for public improvement purposes in the vicinity of Denver West and Colorado Mills; and,
WHEREAS, in 2001, the City entered into an Agreement for Payment of Acquisition Costs (Agreement) with the Lena Gulch Metropolitan District (District); and,
WHEREAS, said District paid for all acquisition costs per the agreement; and,
WHEREAS, some of the parcels acquired under the agreement were impacted by the proposed public improvements such that the entire parcel needed to be acquired; and,
WHEREAS, upon demolition of all existing structures on these parcels, a portion of the property existed outside of the area needed for the public improvements (Remainder Parcel); and,
WHEREAS, the Agreement requires that the City convey all remainder parcels
to the District by Special Warranty Deed.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is authorized to sign and the City Clerk is authorized to attest all special warranty deeds conveying Remainder Parcels that were acquired with District funds under Ordinance O-96-33 to the District.
SECTION 2. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. The expeditious re-use of remainder parcels is necessary to promote economic development and improve tax revenues to the City.
SECTION 3. This ordinance shall take effect upon the signature of the Mayor.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of July, 2003; published in full in the Lakewood Sentinel on the 31st, day of July, 2003; set for public hearing on the 11th day of August, 2003; read, finally passed and adopted by the City Council on the 11th day of August, 2003; and signed and approved by the Mayor on the 12th day of August, 2003.
