ORDINANCE: O-2003-21
SUBJECT: Authorize the transfer of 2 acres of William Fredrick Hayden Green Mountain Park to Jefferson County Open Space to meet Lakewood's obligations under an Intergovernmental Agreement and authorizing the acceptance of a Commissioners Deed from Jefferson County with a reversionary interest in the same property and accept a quit claim deed of a separate parcel.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: In 1998, City Council approved Ordinance O-98-25 authorizing the conveyance of two parcels to Jefferson County. The first parcel was originally conveyed to Lakewood by Jefferson County Open Space for "public open space, park and recreational purposes" but was needed for the construction of improvements to the I-70 and C-470 interchange. The second parcel was property to replace the first parcel under those use restrictions. The deed was signed and recorded but was never formally accepted by Jefferson County, therefore the transaction was never completed.
The Colorado Department of Transportation is now moving forward with the proposed improvements to the interchange and needed the additional right-of-way, which was conveyed under the authorization of O-98-25.
The original replacement parcel identified as Exhibit B in the ordinance is relatively small in size and is not adjacent to any other permanent open space. Jefferson County Open Space and the City believe that a better parcel could be used as the replacement parcel. This ordinance will authorize the conveyance and acceptance of a parcel that is better suited for public open space, park and recreational purposes.
