SUBJECT: Rezoning Case Number RZ-02-009

Rezone a parcel of land located at 8303 West Colfax Avenue from the 4-R (Medium Density Attached Residential) zone district to the 5-C (Large Lot Commercial) zone district for the purpose of creating consistent zoning on the property.

RECOMMENDATION: Staff recommends approval of this rezoning request. Planning Commission, by a vote of 5-0 at the April 16, 2003 hearing, recommended APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The property owner has applied to the City to rezone the property located at 8303 West Colfax Avenue from the 4-R (Medium Density Attached Residential) zone district to the 5-C (Large Lot Commercial) zone district. The applicant is requesting the rezoning for the purpose creating consistent zoning on the property. The property is approximately 5.8 acres in size.

Staff recommends approval of this proposal as outlined in the Staff Report to Planning Commission dated April 9, 2003. At the Planning Commission hearing of April 16, 2003, the Planning Commission heard testimony from the applicant and staff.

The Planning Commission, by a vote of 5-0, recommends approval of the rezoning.
