ORDINANCE: O-2003-13

SUBJECT: Ordinance authorizing the City to convey an easement for gas line facilities to Public Service Company for the main gas line for the existing and future buildings located in the Heritage Center located in the Belmar Park located at 801 South Wadsworth Boulevard.

ADDRESS: 801 South Wadsworth Boulevard.

RECOMMENDATION: Staff recommends approval of this ordinance authorizing conveyance of the easement to Public Service Company.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood relocated a portion of the existing main gas line across Belmar Heritage Center in order to construct the foundation for the White Way Diner. This main gas line provides gas to the service line to the existing buildings and any future buildings that will be placed at the Heritage Center in Belmar Park. As a result of the relocation of a portion of the gas line, an additional easement needs to be conveyed to Public Service Company. Public Service Company agreed to allow the relocation of the gas line prior to the City conveying an easement for the gas line with the understanding that the City would convey the necessary easement after the line was installed and the location of the line was verified by survey. Public Service Company is willing to convey their interests in two prior easements back to the City in exchange for a new easement that describes where the gas line is located. The re-conveyance of the easement will leave only one easement instead of three. This easement is necessary to allow Public Service Company's main gas line to remain in the park and to continue to provide gas service to the existing and future buildings in the Heritage Center. Staff has reviewed the location of the gas line and determined that it is in the right location and will not interfere with the future use of the City land.
