AN ORDINANCE
TO VACATE A PORTION OF THE 24-FOOT SERVICE AND EMERGENCY VEHICLE ACCESS EASEMENT ACROSS LOT 2, BLOCK 1, FIRSTBANK HOLDING COMPANY SUBDIVISION FILING NO. 2, AT 1530 VIEWPOINT ROAD, CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO
WHEREAS, a 24-foot Service and Emergency Vehicle Access Easement purposes crossing Lot 2, Block 1, was dedicated by FIRSTBANK HOLDING COMPANY SUBDIVISION, the plat of which is recorded in Plat Book 122, at Page 57, of the records of the Clerk and Recorder of Jefferson County, Colorado; and
WHEREAS, due to a building construction addition, a portion of said easement is no longer necessary.
BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. Pursuant to Title 43, Article 2, Colorado Revised Statutes, Case No. VA-03-02, and upon a finding that the described area is no longer necessary for use by the public and that no land would by a vacation be left without an established public road connecting same with another established public road, the property described in Exhibit "A" attached hereto be and the same is hereby vacated.
SECTION 2. The City Clerk is authorized and directed to record a certified copy of this Ordinance with the Jefferson County Clerk and Recorder.
SECTION 3. This ordinance shall take effect thirty (30) days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of April, 2003, published in full in the Lakewood Sentinel on the 1st day of May, 2003; set for public hearing on the 12th day of May, 2003; and signed and approved by the Mayor on the 13th day of May, 2003.

A parcel of land being a portion of that 24' Service and Emergency Vehicle
Access (SEVA) Easement, lying in Lot 2, Block 1, as shown and dedicated to the
City of Lakewood by FIRSTBANK HOLDING COMPANY SUBDIVISION FILING NO. 2, the
plat of which is recorded in Plat Book 169, Pages 35, 36 of the records of the
Jefferson County Clerk and Recorder and further lying within the Southeast One-quarter
(SE¼) of Section 32, Township 3 South, Range 69 West of the Sixth Principal
Meridian, City of Lakewood, County of Jefferson, State of Colorado, and being
more particularly described as follows:
Commencing at the South Quarter Corner of said Section 32; thence N 89º41'00"E along the South line of said SE¼, a distance of 635.24 feet; thence N 00º19'00" W and departing said South line, a distance of 169.81 feet to a point being the most southeasterly corner of said Lot 2; thence N 00º11'28" W along the East line of said Lot 2, a distance of 38.09 feet to a point being the Southeast corner of said 24' SEVA Easement and said point being the True Point of Beginning; thence S 89º41'11" W along the South line of said 24' SEVA Easement, a distance of 128.34 feet, more or less, to a point of curvature; thence along an arc of a curve to the right having a radius of 37.00 feet and a central angle of 90º00'00", an arc distance of 58.12 feet; thence N 00º18'49" W, a distance of 165.10 feet to a point of curvature; thence along an arc of a curve to the left having a radius of 13.00 feet and a central angle of 90º00'00", an arc distance of 20.42; thence N 00º11'28" W departing said South 24' SEVA Easement line, a distance of 24.00 feet to a point lying on the North line of said 24' SEVA Easement and said point also being a point of a non-tangent curve; thence along an arc of a curve to the right having a radius of 37.00 feet and a central angle of 90º00'00" (the long chord of which bears S 45º18'49" E, a long chord length of 52.33 feet), an arc distance of 58.12 feet; thence S 00º18'49" E, a distance of 165.10 feet to a point of curvature; thence along an arc of a curve to the left having a radius of 13.00 feet and a central angle of 90º00'00", an arc distance of 20.42 feet; thence N 89º41'11" E, a distance of 128.50 feet, more or less to a point lying on said East line of Lot 2; thence S 00º11'28" E along said East line, a distance of 24.00 feet to the True Point of Beginning.
