ORDINANCE: O-2003-9
SUBJECT: An Ordinance Amending the definition of household in the Lakewood Zoning Ordinance to include foster family members within the definition of immediate family.
RECOMMENDATION: Adopt the Ordinance amending Section 17-2-2(164) of the Lakewood Zoning Ordinance relating to the definition of household.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The purpose of the recommended ordinance is to amend the current definition of household relating to the number of registered sex offenders who can reside within a single household. On June 28, 1999, the Lakewood City Council amended the then current definition of household to provide that "a household shall not include more than one individual who is required to register as a sex offender under the provisions of the Colorado Revised Statutes, § 18-3-412.5, as amended." Members of an immediate family were exempt from this provision.
As a result of the January 13, 2003, decision of the Colorado Supreme Court in the case of City of Northglenn v. Juliana Ibarra, it is necessary that the exemption for immediate family members be broadened to include foster family members.
