SUBJECT: Amending Title 1 of the Lakewood Municipal Code pertaining to General Provisions

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Section 1.16.040 Failure to pay fines and costs, specifies that "court costs shall be fifteen dollars for a plea of guilty or nolo contendere or a trial to the court, and forty five dollars for a trial to a jury."
The Municipal Court reviews fine schedules, fees and costs annually. In order to change the court costs it is currently necessary to pass an amendment to this section of the ordinance.
It is hereby proposed that the ordinance be changed to allow for the Presiding Municipal Judge to prepare and maintain a schedule of court costs. This would allow for future changes in court costs to be determined by the Presiding Municipal Judge and eliminate the need for an ordinance amendment.
