LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY

October 23, 2003

Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1. CALL TO ORDER

Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.

ITEM 3. NEW APPLICATION

Hotel & Restaurant License
Gauchos CO, L.L.C.
d/b/a Tucanos Brazilian Grill
14500 W. Colfax Ave. #359

Deputy City Attorney Kennebeck stated that he had reviewed this application and all the paperwork appeared to be in order.

Joseph Heeb, 13701 W. Jewell Ave. #250, Lakewood, appeared before the Authority and was sworn in.

Mr. Heeb testified that this restaurant is currently under construction at the new Colorado Mills Mall. In response to questions from the Authority, he stated that he has not attended any alcohol classes, but is willing to send his employees to a class if that is the Authority's desire.

Tina Scott, 1216 Tipperare St., Boulder, appeared before the Authority and was sworn in. She testified that she is appearing on behalf of Oedipus, Inc., who is the company contracted by the applicant to conduct the neighborhood survey. She testified to how the survey was conducted and the results of that survey.

No one appeared in support or opposition of the application and the Chairman closed the public hearing.

Ms. Hansson moved that the application for a Hotel and Restaurant License for Gauchos CO, L.L.C., d/b/a Tucanos Brazilian Grill, 14500 W. Colfax Ave. #359 be approved. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.

ITEM 4. GENERAL BUSINESS

(A) Issue Complaint and Order to Show Cause and set hearing date for the Retail Liquor Store License of 12065 West Alameda, Inc., d/b/a Norman's Liquors, located at 12065 West Alameda Pkwy.

Deputy City Attorney Kennebeck stated that there is probable cause to believe this licensee sold alcohol to a minor during a compliance check conducted by the Police Department on the evening of October 1, 2003. The City is asking the Authority to issue a complaint against this licensee.

Mr. Wolfe moved to hold to a date certain of January 22, 2004, the complaint and order to show cause hearing for 12065 West Alameda, Inc., d/b/a Norman's Liquor, 12065 W. Alameda Pkwy. The motion was seconded and with those present voting Aye, THE MOTION TO ISSUE A COMPLAINT CARRIED.

(B) Issue Complaint and Order to Show Cause and set hearing date for the
3.2% Off Premise Fermented Malt Beverage License of 7-Eleven, Inc., d/b/a Seven Eleven #17134, located at 9200 W. Alameda Ave.

Deputy City Attorney Kennebeck stated that there is probable cause to believe this licensee sold alcohol to a minor during a compliance check conducted by the Police Department on the evening of October 1, 2003. The City is asking the Authority to issue a complaint against this licensee.

Mr. Williams moved to hold to a date certain of January 22, 2004, the complaint and order to show cause hearing for 7-Eleven, Inc., d/b/a Seven Eleven #17134, 9200 W. Alameda Ave. The motion was seconded and with those present voting Aye, THE MOTION TO ISSUE A COMPLAINT CARRIED.

(C) Issue Complaint and Order to Show Cause and set hearing date for the
3.2% Off Premise Fermented Malt Beverage License of Recuperos, L.L.C., d/b/a Everyday Store #5713, located at 1090 S. Union Blvd.

Deputy City Attorney Kennebeck stated that there is probable cause to believe this licensee sold alcohol to a minor during a compliance check conducted by the Police Department on the evening of October 1, 2003. The City is asking the Authority to issue a complaint against this licensee.

Mr. Wisneski moved to hold to a date certain of January 22, 2004, the complaint and order to show cause hearing for Recuperos, L.L.C., d/b/a Everyday Store #5713, 1090 S. Union Blvd. The motion was seconded and with those present voting Aye, THE MOTION TO ISSUE A COMPLAINT CARRIED.

(D) Issue Complaint and Order to Show Cause and set hearing date for the
3.2% Off Premise Fermented Malt Beverage License of Recuperos, L.L.C., d/b/a Everyday Store #5714, located at 12015 W. Cedar Dr.

Deputy City Attorney Kennebeck stated that there is probable cause to believe this licensee sold alcohol to a minor during a compliance check conducted by the Police Department on the evening of October 1, 2003. The City is asking the Authority to issue a complaint against this licensee.

Ms. Stevens moved to hold to a date certain of January 22, 2004, the complaint and order to show cause hearing for Recuperos, L.L.C., d/b/a Everyday Store #5714,
12015 W. Cedar Dr. The motion was seconded and with those present voting Aye, THE MOTION TO ISSUE A COMPLAINT CARRIED.

(E) Issue Complaint and Order to Show Cause and set hearing date for the Retail Liquor Store License of Aster Gebremeskel, d/b/a Reeb Liquors, located at 11000 W. Alameda Ave.

Deputy City Attorney Kennebeck stated that there is probable cause to believe this licensee sold alcohol to a minor during a compliance check conducted by the Police Department on the evening of October 1, 2003. The City is asking the Authority to issue a complaint against this licensee.

Mr. Wisneski moved to hold to a date certain of January 22, 2004, the complaint and order to show cause hearing for Aster Gebremeskel, d/b/a Reeb Liquors, 11000 W. Alameda Ave. The motion was seconded and with those present voting Aye, THE MOTION TO ISSUE A COMPLAINT CARRIED.

ITEM 5. ADJOURNMENT

There being no further business to come before the Authority, Chairman Taake adjourned the meeting at 7:35 p.m.
