REGULAR MEETING OF
LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY

January 23, 2003

Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1. CALL TO ORDER

Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.

ITEM 3. SHOW CAUSE HEARING

Retail Liquor Store License
Mack's Liquor, Inc., dba Mack's Liquor
11712 W. Colfax Ave.

Deputy City Attorney Kennebeck explained to the Authority that this matter was before them as the result of a complaint that was issued for an alleged violation arising out of a compliance check. The complaint was issued for the sale of alcohol to a minor on September 25, 2002. This matter was originally scheduled for December 12, 2002, and continued to this evening at the request of the licensee. In the meantime, another Show Cause Order was issued for another violation of selling alcohol to minors that allegedly occurred on December 12, 2002. Mr. Kennebeck has had several conversations with both the licensee and his attorney about the possibility of a stipulation.

Thomas Dunn, registration #9395 appeared on behalf of the licensee. He testified that it is the licensee's intent to enter into a stipulation with the City. The licensee would like the opportunity to sell his business and the stipulation, if approved by the Authority would allow him to do just that.

James Brennan, 2460 Jay St., owner, appeared before the Authority and was sworn in. He explained the actions of his employees who were cited for selling alcohol to minors. He asked the Authority not to revoke his license and allow him the opportunity to sell his business.

Chairman Taake closed the public testimony portion of the hearing and discussed the merits of the stipulation amongst themselves. The terms of the stipulation are that the licensee must sell the business by May 15, 2003, or turn his license into the City Clerk's Office on May 16, 2003.

Ms. Hansson moved to accept the stipulation between the Deputy City Attorney and Mack's Liquor, Inc., dba Mack's Liquor, 11712 W. Colfax Ave. The motion was seconded and with those present voting Aye, THE MOTION TO ACCEPT THE STIPULATION CARRIED.

ITEM 4. GENERAL BUSINESS

Mr. Weakly tendered his resignation effective immediately. Mr. Monsoor informed the Liquor Authority that he will be resigning effective June 2003.

ITEM 7 - ADJOURNMENT

There being no further business to come before the Authority, Chairman Fred Taake adjourned the meeting at 9:30 p.m.
