A RESOLUTION

AUTHORIZING A RIGHT-OF-WAY USE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND RICOCHET NETWORKS, INC., TO ALLOW FOR THE INSTALLATION, MAINTENANCE AND REPLACEMENT OF WIRELESS INTERNET EQUIPMENT WITHIN RIGHTS-OF-WAY AND EASEMENTS OWNED BY THE CITY OF LAKEWOOD.

WHEREAS, Metricom Inc., had installed a number of wireless internet facilities within City-owned rights-of-way and easements and subsequently went bankrupt; and

WHEREAS, Ricochet Networks, Inc. (RNI) desires to re-establish this network; and,

WHEREAS, RNI has requested that the City of Lakewood grant a Right of Way Use Agreement to allow installation and maintenance of the equipment; and

WHEREAS, RNI will provide wireless modems to the City of Lakewood for City use which will provide improved access to information by police agents and other City employees in the field; and

WHEREAS, the City wishes to allow said use of the portion of said street right-of-way and easements, for the continued use of these improvements in accordance with the terms and conditions of a Right of Way Use Agreement between the City and RNI.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Right of Way Use Agreement between the City of Lakewood and Ricochet Networks, Inc., for the installation, maintenance and use of wireless internet equipment within City owned rights-of-way and easements.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on November 25, 2002, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
