A RESOLUTION

AUTHORIZING THE CITY OF LAKEWOOD TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH JEFFERSON COUNTY AND THE LENA GULCH METROPOLITAN DISTRICT RELATING TO THE CONSTRUCTION OF WEST 8TH AVENUE

WHEREAS, West 8th Avenue, West 7th Avenue and Fig Street are owned and maintained by the City and the County; and

WHEREAS, it is necessary for the future development of the Colorado Mills retail center to construct certain improvements and detours related to West 8th Avenue and West 7th Avenue and Fig Street (the "Project"); and

WHEREAS, the City, the County and the Lena Gulch Metropolitan District wish to evidence the fact that the District will construct and fund the Project; and,

WHEREAS, the City and the County wish to ensure that plans are developed for the improvement of West 7th Avenue and Fig Street to collector street standards.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City is authorized to enter into an Intergovernmental Agreement with Jefferson County and the Lena Gulch Metropolitan District which provides that the Lena Gulch Metropolitan District will construct and fund the Project and that plans are developed for the improvement of West 7th Avenue and Fig Street to collector street standards.

SECTION 2. The City Manager is authorized to execute and the City Clerk to attest to the Agreement, in form approved by the City Attorney.

SECTION 3. This Resolution shall be in full force and effect upon its passage and approval.

INTRODUCED, READ AND ADOPTED by a vote of _____ for and _____ against at a regular meeting of the City Council on October 28, 2002, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
