RESOLUTION: 2002-72

SUBJECT: Approval of a Memorandum of Understanding between the City of Lakewood, Regional Transportation District and the United States General Services Administration.

RECOMMENDATION: To approve the Memorandum of Understanding between the City of Lakewood, Regional Transportation District and the United States General Services Administration.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: On August 22, 2002, the Mayor of Lakewood, the General Manager of the Regional Transportation District and senior managers from the United States General Services Administration and their respective staff met to conclude a collaborative process that resulted in the anticipated development of a transit-friendly master plan for the Lakewood Urban Center. As a result of that process the parties have decided to use their best efforts to collectively move forward with the formulation of the Lakewood Urban Center Master Plan. Collectively the City of Lakewood, RTD and GSA committed to (1) use the master plan vision to guide development; (2) develop and sign an Memorandum of Understanding by mid-October; (3) formulate and adopt a master plan; (4) continue to explore options for implementation; and (5) collectively manage the public relations for the Lakewood Urban Center Master Plan.

Lakewood Urban Center
Memorandum of Understanding
Between The City of Lakewood, The Denver Regional Transportation District and The General Services Administration

Objectives
The parties agree to cooperate to achieve a common long-term vision for a community friendly, environmentally sound, safe and efficient transit facility to serve the west metropolitan area. The parties understand the need for the construction of an expanded permanent facility, to be located in the Denver Federal Center, and capable of accommodating any future light rail terminal as well as buses. This memorandum of understanding formalizes the mutual commitment of the City of Lakewood, the Denver Regional Transportation District and the United States General Services Administration to accomplish the vision of a Westside Intermodal Facility and to be a centerpiece for a transit-oriented urban center located in the Denver Metro area. When completed, the transit-oriented urban center will be the most thorough example to date of transit-oriented development in the Denver Region and likely to serve as a textbook model for sustainable urban growth for the Denver region.

Statement of Work
On August 22nd the Mayor of Lakewood, the General Manager of the Regional Transportation District and senior mangers from the United States General Services Administration and their respective staff met to conclude a collaborative process that resulted in the development of a transit-friendly master plan for the Lakewood Urban Center. As a result of that process the parties have decided to use their best efforts to collectively move forward with the implementation of the Lakewood Urban Center Master Plan.

In broad terms, the parties are committed to:

1. Use the Master Plan Vision to Guide Development. The parties agree to use the Lakewood Urban Center Master Plan as an appropriate vision to guide the future development of the site. The Denver Federal Center has been identified as the site for the Lakewood Urban Center. The Denver Federal Center is generally located east of Kipling Street, west of Union Boulevard, south of Sixth Avenue, and north of West Alameda Parkway.

2. Develop and Sign an MOU by mid-October. The parties agree to develop and sign a Memorandum of Understanding (MOU) expressing their intent to work together to guide the implementation of the Urban Center Master Plan. The parties are aiming towards a mid-October 2002 target to conclude the MOU.

a. Colorado Department Of Transportation and Colorado Department Public Health and Environment will be approached and asked to be concurring parties to the MOU.

b. The Mayor of Lakewood will prepare a letter on joint stationary expressing the parties collective resolve to move forward on the master plan and development of the site

3. Adoption of the Master Plan by the Parties. The parties agree to place a priority on adopting the Urban Center Master Plan within the appropriate framework of each agency.

a. The City of Lakewood will take the first step with moving to adopt the plan as part of their comprehensive plan.

4. Continue to Explore Options for Implementation. The parties will form an "implementation committee" to explore appropriate strategies and opportunities for:

a. Exploring the range of options for implementation and recommending a preferred approach.

b. Financing the early implementation of a new Intermodal center, including the exploration of Public Private Initiatives.

c. Understanding and utilizing the General Services Administration "land exchange" vehicle.

d. Moving forward with resolving clean-up of the site.

5. Collectively Manage the Public Relations for the Plan. The parties agree to work together in a proactive to manage the positioning, public "unveiling" and the political dynamics of the project. Even though a MOU has not been signed, it remains important that the parties put a consistent face on issues concerning the fate of the Master Plan.
