SUBJECT: Consolidation of Senate Bill 8 Agreements

RECOMMENDATION: Council authorize an agreement between the City of Lakewood and the Colorado Department of Transportation for the consolidation of two State of Colorado agreements known as Senate Bill 8.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood maintains and operates 62 signals on state highways in Lakewood under an agreement authorized by the State of Colorado. The authorization was passed into law as Sections 42-4-502, 43-1-106, 43-2-102, 43-2-135, and 43-2-144 Colorado Revised Statutes, 1973, as amended. Because of the limited staff and the large number of traffic signals throughout the state, this authorization allows the Colorado Department of Transportation to contract with local agencies for the operation and maintenance of traffic signal devices on state highways. The State of Colorado has designated this maintenance agreement as Senate Bill 8, and this designation appears on all official documents. In October 2001, the Colorado Department of Transportation, the City of Lakewood, and the Lena Gulch Metropolitan District, a special district for the Denver West Development Area, entered into a separate Senate Bill 8 agreement with Lakewood for the maintenance and operation of an additional 11 traffic signals on state highways in the Lena Gulch District. This Senate Bill 8 Agreement, and the one currently in place, are to be consolidated into one agreement. This is a "house keeping" item with the State of Colorado. City Council has previously authorized resolutions for both Senate Bill 8 Agreements.
