RESOLUTION: 2002-54
SUBJECT: Intergovernmental Agreement Housing And Treatment Of Juvenile Registered Sex Offenders.
RECOMMENDATION: Staff recommends approval of the Intergovernmental Agreement.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The following information outlines specific information about the content of the proposed IGA.
· The parties to this agreement include Jefferson County, Arvada, Golden, Lakewood, Westminster, and Wheat Ridge.
· The cities and county recognize and agree that the housing and treatment of Juvenile Registered Sex Offenders is a matter of county-wide interest, requiring the development and implementation of a comprehensive agreement among all of the affected jurisdictions to assure that the housing and treatment of such juveniles balances the health, safety, and welfare of both the individual juveniles and the entire community.
· The parties agree that the IGA needs to provide reasonable conditions and requirements that will provide necessary and appropriate land use. Additional regulations will promote the health, safety, and welfare of both the individual juveniles and the entire community.
· The IGA creates a new Board called the "Jefferson County Zoning Compliance Board" authorized to approve and monitor the Group Living Quarters for compliance with Local and State standards and requirements. The Board (7 members) is to be comprised of one appointee from each of the five cities and two appointees from Jefferson County.
· The Parties agree that the creation of a Jefferson County Zoning Compliance Board is the most effective way to deal with the housing, treatment, and location of Juvenile Registered Sex Offenders.
· The Parties have agreed that dispersion of facilities throughout the County and Cities is appropriate.
· The Board shall approve/deny/suspend and/or revoke a Certificate of Operation for each facility.
· Operators of facilities need to meet the requirements set forth in
the Certificate of Operation and also meet local Zoning Standards as listed
below.
DRAFT ZONING REGULATIONS FOR
COUNTY AND CITIES
CREATE NEW ZONING REGULATIONS IN JEFFERSON COUNTY AND THE FIVE CITIES TO INCLUDE:
· Allowance of "Group Living Quarters for Juvenile Registered Sex Offenders" as a permitted use (approved administratively) in Commercial/Industrial Zone Districts.
· Maximum of 15 residents in the Group Living Quarters.
· Group Living Quarters building to be no closer than 3500 feet from any same type of facility.
· No closer than 500 feet from schools, day care centers and adult entertainment use.
· No closer than 100 feet from residentially zoned property.
· Operator shall be licensed to treat offenders.
· Operator shall have a security plan and Neighborhood Public Involvement Plan for each facility.
· The facility/operator needs to obtain a Certificate of Operation from the newly created "Jefferson County Juvenile Registered Sex Offender Zoning Compliance Board" before opening.
