SUBJECT: A resolution adopting the second amendment to the Colfax-Wadsworth Reinvestment Plan.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Colfax-Wadsworth Reinvestment Plan was adopted by the City Council on August 9, 1999. The Reinvestment Area is located in northeast Lakewood and is generally bounded by Wadsworth Boulevard on the west, Teller Street on the east, 17th Street on the north and West Colfax Avenue on the south. 1605, 1611, 1625, 1631 and 1645 Vance Street are located at the north edge of the Reinvestment Area, on the south side of 17th Street.

On October 22, 2001, the City Council approved rezoning to 5C-Conditional the Colfax-Wadsworth Reinvestment Area and the properties at 1605, 1611, 1625, 1631 and 1645 Vance Street.

The properties at 1605, 1611, 1625, 1631 and 1645 Vance Street are necessary for the redevelopment. Inclusion in the Area would give (the owners) greater flexibility in reinvesting the proceeds after the sale to the selected developer. The following comparison illustrates the effect of including the properties at 1605, 1611, 1625, 1631 and 1645 Vance Street in the Colfax-Wadsworth Reinvestment Area approved August 9, 1999:

The inclusion of these properties will require an amendment to the Colfax-Wadsworth Reinvestment Plan. Modification of the Plan is governed by C.R.S. 31-25-107(7). This section distinguishes between major and minor modifications to the urban renewal plan. Major modifications require public hearing and referral requirements similar to that for the original plan. However, the City Council can determine that the modification will not substantially change the urban renewal plan and can approve the modification by resolution without the referral and publication requirements.

The City Council must determine that the modification will not substantially change the urban renewal plan based on the land area of the modification, the likely land use of the modification, the design, building requirements, timing or procedure that have been previously approved.
