REQUEST FOR COUNCIL ACTION

RESOLUTIONS: 2002-13

SUBJECT: Approving the Service Plan for the Vance Street Metropolitan District No. 1, and the Vance Street Metropolitan District No. 2.

ADDRESS: Vance Street Re-development (Colfax & Wadsworth)

RECOMMENDATION: Staff recommends that City Council approve the service plan as submitted.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: State statute requires that any persons requesting the formation of a special district located totally within the boundaries of a municipality must obtain a resolution from the governing body of that municipality approving the district. Persons representing The Vance Street Metropolitan Districts are requesting the approval.

This plan is a "skeleton" plan for approval. The City Council approval allows the District organizers to pursue statutory procedures to place questions on the ballot at the May 2002 election. There is no financial information offered or approved, and neither district is authorized to take any actions at all except to organize and perform the minimum functions necessary to maintain their legal existence. Both districts will be required to obtain an amendment to their respective Service Plans before they will have authority to design or build any improvements, to certify any tax levy or to incur or issue any debt. The service plans and resolutions for approval thereof are included.
