ORDINANCE: O-2002-50
SUBJECT: Ordinance accepting a Commissioner's Deed for the conveyance of the West One-half of the Yarrow Street right-of-way between West 14th Avenue and West 13th Avenue, to the City of Lakewood and authorizing the City to convey a portion of this right-of-way to The Housing Authority of the City of Lakewood.
ADDRESS: Yarrow Street between West 14th Avenue and West 13th Avenue.
RECOMMENDATION: Adoption of this ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Housing Authority for the City of Lakewood is in the process of purchasing the properties located at 1351 Yarrow Street and 1330 and 1350 Zephyr Street. It came to their attention that one of the buildings and some of the site improvements, which were built in 1968, at 1351 Yarrow Street are encroaching on the Yarrow Street right-of-way. The owner of record for this right-of-way was Jefferson County, therefore, the Housing Authority requested through the County Attorney to have that portion of the right-of-way adjacent to 1351 Yarrow street be conveyed to the Housing Authority. The attorney said it would be more convenient for them to convey the right-of-way to the City and then the Housing Authority and City could do the necessary documents to clear the title to the property. The Commissioner's Deed for this right-of-way was executed November 19, 2002, and recorded at the Jefferson County Clerk and Recorder on November 25, 2002. Now that the City owns the right-of-way a Quit Claim Deed needs to be signed by the City conveying that portion of the right-of-way that has these encroachments within the right-of-way to the Housing Authority in order to clear the title to the property. The right-of-way that was conveyed to the City is outlined in red and that portion of the right-of-way that needs to be conveyed to the Housing Authority is outlined in green on the enclosed map. Traffic Engineering has reviewed this request and has no concerns with the City conveying the proposed portion of the right-of-way back to the Housing Authority.
