SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The proposed ordinance amends Title 2, pertaining to administration and personnel, by amending Section 2.20.155, Marshals-Authority. This provision sets forth the specific law enforcement authority, which is granted to court marshals. The proposed amendment makes it clear that the marshals have the authority to transport, detain, and maintain control over both municipal court prisoners and police department prisoners. Part-time marshals have been assisting the police department by transporting police department prisoners to the county jail. This assistance has decreased the amount of time patrol agents spend transporting prisoners.
