ORDINANCE: O-2002-41
SUBJECT: Ordinance authorizing the of vacation of a portion of Arbutus Street at 13300 West Sixth Avenue, City of Lakewood, County of Jefferson, State of Colorado.
ADDRESS: 13300 West Sixth Avenue.
RECOMMENDATION: Adoption of the attached ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Arbutus Drive right-of-way crosses the Red Rocks Community College property from West Sixth Avenue Frontage Road South to Red Rocks Community College South property line. It was conveyed to the City by an easement from the State of Colorado. Since that conveyance, part of Arbutus Drive has been relocated to allow for better traffic circulation through the property. Due to this relocation that portion of Arbutus Drive lying South of the most westerly traffic circle is no longer being use as a public street but as access to a student parking lot. Because this portion of the street is no longer used as a public street, this portion of the street right-of-way should be vacated so that the City will no longer have the maintenance responsibility of the street. The City, however, is reserving an easement across this property for service and emergency vehicle access and for existing above and below ground utilities. City staff recommends adoption of this Ordinance vacating any interests the City may have in this right-of-way.
