REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-38

SUBJECT: Proposed ordinance amendment to 8.14 of the Lakewood Municipal Code increasing administrative fees associated with the removal and enforcement of violations of this section. Also adding further regulations concerning the placement and storage of trash containers located outside.

RECOMMENDATION: Staff recommends approval of this ordinance amendment request.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The ordinance concerning administrative fees has not been revised since the early 1990's when originally adopted. The fees in this program have been calculated to be consistent with the fees associated with the graffiti removal program and the nuisance code. The current administrative fee in this chapter is $75.00 and the proposed fee is $100.

There has been an ongoing dialogue about the current trash ordinance since July 2001. Staff was directed to bring an ordinance amendment forward that limits the outdoor storage and placement of trash containers in the City. A survey of other jurisdictions' trash regulations was conducted and taken into account in preparing this amendment. The amendment requires trash containers to be screened from view when not out for pickup. It also adds further regulations concerning the placement of commercial size dumpsters and regulations for the temporary placement of roll off dumpsters. This ordinance will be enforced on a complaint basis only.
