Ordinance 2002-33 Background REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-33

SUBJECT: Emergency Ordinance vacating rights of way for alleys and streets located in or adjacent to Block 37 Plat of Lakewood.

ADDRESS: Area bounded by 11th Avenue, Pierce Street, 10th Avenue and Reed Street.

RECOMMENDATION: Approve the Ordinance.

FUNDING SOURCE: Not applicable.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The original Plat of Lakewood created lots blocks and tracts for the entire area between Colfax Avenue, Sheridan Boulevard, 10th Avenue and Carr Street in 1888 and re-platted in 1890. Various parcels were developed over the course of the following decades.

As part of a review of a minor subdivision that is presently being processed, it has been discovered that some rights of way may not have been vacated. Some improvements such as houses and garages span over these areas. The rights of way being vacated have not been developed for public use.

The emergency provision will expedite the vacation of these rights of way and facilitate the minor subdivision, thus clarifying the title of the parcels contained within the minor subdivision.
