Ordinance 2002-30 REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-30

SUBJECT: Proposed ordinance amendments adding, clarifying and amending various sections of 9.80.010 and 9.80.020 of the Lakewood Municipal Code pertaining to the parking of motor vehicles and adding the definition of Multiple Household Dwelling found in Title 17, Article 2 of the Zoning Ordinance.

RECOMMENDATION: Staff recommends approval of this ordinance amendment request to aid in the enforcement and clarity of this section of the Municipal Code as well as to be consistent with Article 9 of the Zoning Ordinance.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

During the course of the enforcement of Title 9 of the Municipal Code and Article 9 of Title 17, Code Enforcement staff has come across sections of the Code that should be clarified or modified in order to insure terms are consistent and to facilitate ease in education as well as enforcement. Staff has determined that there is a need to modify Title 9 of the Municipal Code in order to correct conflicts and clarify issues relating to the storage and parking of inoperable motor vehicles on private property in the City of Lakewood. In addition, feedback has been received from Municipal Court personnel that have been incorporated in these changes. The specific changes include:

· Adding the term "parking" wherever "storage" of motor vehicles is mentioned
· Changed the title of "junk" motor vehicle to "inoperable/unlicensed" motor vehicles
· Added definition of multiple household dwelling from Title 17 of the Zoning Ordinance to Title 9 of the Municipal Code
· Added wording to clearly articulate that inoperable/unlicensed motor vehicles are not allowed to be parked outside on properties where there is a multiple household dwelling unit
· Added wording to clearly articulate that trailers that are not licensed or operable are not allowed to be parked outside in residential areas unless otherwise allowed by ordinance
