Ordinance 2002-29 REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-29

SUBJECT: Ordinance authorizing the conveyance of a quitclaim deed for 20 feet of property adjacent to Alameda Avenue right-of-way in exchange for a quitclaim deed for 30 feet of Alameda Avenue right-of-way, further declaring an emergency.

ADDRESS: Adjacent to 8525 W. Alameda Avenue - North side of Alameda Avenue west of Cody Street.

RECOMMENDATION: Approve the Ordinance.

FUNDING SOURCE: Not applicable.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The property owner of 8525 W. Alameda is in the planning stages of constructing site improvements. The platted lot lies 50 feet north of the section line. The title is clouded for the 50 feet north of the section line and south of the platted lot.

The City and the property owner have negotiated an agreement by which, the property owner would quit claim the south 30 feet to Lakewood and Lakewood would quit claim the north 20 feet to the property owner. This would clarify the title for the 50 feet for both parties concerned. This arrangement is identical to the agreement that was recently approved by the City Council for the area adjacent to 8405 W. Alameda Avenue which lies directly across Cody Street to the east.
